A South Carolina woman has filed a lawsuit against DePuy alleging that she has suffered serious complications due to her Pinnacle hip implant failure.
The plaintiff, Faith T., underwent hip surgery in May 2009. She was implanted with a DePuy Pinnacle hip implant device in her right hip. Unfortunately, following the surgery, Faith says she suffered from Pinnacle hip implant failure and subsequent complications.
As a result of the Pinnacle hip implant failure, Faith underwent a revision surgery to alleviate these problems in February 2015, removing and replacing the failed implant.
Of course, any extra surgery including revision surgery brings with it its own additional risks, such as infection. Even after the revision surgery, Faith claims that she still suffers from continuous pain in her right hip, and that her injuries may be permanent.
According to Faith’s hip replacement lawsuit, DePuy was actually fully aware of the risk of Pinnacle hip implant failure prior to her implantation with the device, but failed to warn the plaintiff or her doctors, as well as the general public.
The Pinnacle hip implant failure lawsuit was filed on multiple counts, including failure to warn, negligence, design defect, manufacturing defect, breach of express and implied warranties, negligent misrepresentation, fraud and punitive damages.
Faith filed her Pinnacle hip implant failure lawsuit on Aug. 14 in the U.S. District Court for the Northern District of Texas.
According to the lawsuit, DePuy has received over 1,300 individual reports of problems associated with its Pinnacle Hip implants, including Pinnacle hip implant failure.
Basics of the DePuy Pinnacle Hip Implant Device
The DePuy Pinnacle hip device was released onto the market in 2001, and was intended to replace hip joints damaged by a number of conditions. The DePuy Pinnacle hip implant device is a popular hip implant option, widely used across the country.
Indeed, according to DePuy, almost 150,000 people have undergone a total hip replacement with this particular system. Unfortunately, this widespread usage of the DePuy Pinnacle hip implant means that any defects have the potential to affect a large number of patients.
The DePuy Pinnacle hip implant has been linked with a number of serious problems, including metallosis, toxicity and a high rate of Pinnacle hip implant failure.
Thousands of lawsuits have so far been filed over serious problems with the DePuy Pinnacle device. The DePuy Pinnacle hip implant has even been taken off of Australia’s medical market because of its high rate of failure.
Filing a DePuy Pinnacle Hip Implant Failure Lawsuit
Lawsuits like Faith’s claim that DePuy failed to adequately warn the public and the medical community about the risks associated with the DePuy device, including Pinnacle hip implant failure.
Had the plaintiffs been adequately informed of these risks, lawsuits claim, they may not have had the device implanted in the first place and could have avoided these painful hip replacement problems.
If you or someone you love has experienced hip replacement problems due to DePuy Pinnacle hip implant failure, you may be able to file a lawsuit. Filing a lawsuit cannot take away the pain and suffering caused by device defects, but it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Pinnacle Hip Implant Failure Lawsuit is Case No. 3:17-cv-02143-K, in the U.S. District Court for the Northern District of Texas.
