Hernia Mesh ComplicationsA proposal for any new Atrium C-Qur hernia mesh injury cases to be filed directly into the multidistrict litigation (MDL) has been approved by the U.S. District Judge in charge of presiding over these cases.

These hernia mesh injury cases are product liability claims, alleging that the plaintiffs have suffered serious injuries after undergoing hernia repair surgery.

All pending Atrium C-Qur hernia mesh injury cases were initially consolidated by the U.S. Judicial Panel on Multidistrict Litigation (JPML) in December 2016. The hernia mesh injury cases were centralized in the District of New Hampshire before U.S. District Judge Landya McCafferty.

Centralization of hernia mesh injury cases is meant to help avoid conflicting rulings and duplicative discovery, and generally serves as a convenience for both parties.

The hernia mesh injury cases make similar claims, alleging that the Atrium C-Qur mesh device was defective, thereby posing a serious danger for patients.

Indeed, hernia mesh injury cases allege that the devices posed dangerous risks like adhesions, infections, allergic reactions, and other complications. Lawsuits further claim that these injuries led to the need for removal of the mesh device.

Judge McCafferty’s move to allow future Atrium C-Qur hernia mesh injury cases to be filed directly into the MDL is meant to avoid transfer delays from other U.S. District Courts across the country.

Atrium C-Qur Hernia Mesh Devices

The Atrium C-Qur hernia mesh patch entered the market in 2006 for hernia repair surgery. The mesh is coated with Omega-3 gel, meant to help the mesh adhere to the abdominal wall but reduce the formation of scar tissue there.

However, according to hernia mesh injury cases, it is this very coating that can cause serious complications. Indeed, lawsuits claim that the coating can cause inflammation, adhesion and other problems.

Hernia repair patients who show any hernia mesh failure symptoms indicating inflammation or infection should seek medical attention. However, the hernia mesh removal surgery that may be required to prevent further complications is itself a dangerous procedure.
