A group of plaintiffs from fifteen separate states collectively filed an Essure complications lawsuit in March, alleging that they suffered from a number of serious injuries because of the device.
The women involved in this Essure complications lawsuit come from all across the country, from Kentucky to Michigan, New Jersey and Texas.
Bayer has asked that this Essure complications lawsuit be removed from the Circuit Court in St. Louis to the U.S. District Court for the Eastern District of Missouri.
Essure Background
Essure is one of the more popular methods of permanent birth control currently available on the market. The device consists of two metal coils implanted into a patient’s fallopian tubes.
After the device is implanted, it takes two or three months for the coils to become effective. During this time, the coils expand in place as the surrounding tissue grows around them. After these first few months, the coils and tissue will have joined together completely, blocking the fallopian tubes and preventing pregnancy.
Essure is manufactured by Bayer Healthcare and was approved by the U.S. Food and Drug Administration (FDA) in 2002. Bayer markets this birth control method as safe and effective, more so than other options.
But a growing number of lawsuits claim that Essure is neither as safe nor as effective as Bayer claims it to be. Indeed, more and more women are coming forward with allegations that Essure actually causes serious side effects, its complications outweighing its benefits.
Essure Lawsuits
According to plaintiffs in this Essure complications lawsuit and others like it, thousands of women implanted with Essure devices have suffered from severe complications.
Plaintiffs allege that after undergoing the procedure for the Essure device, they began experiencing a number of serious symptoms. Women have reported complications including, but not limited to, the following:
- device migration
- hysterectomy
- abdominal pain
- pelvic pain
- back pain
- bloating
- weight gain/fluctuation
- heavy menstrual bleeding
- irregular menstrual cycles
- depression
- fatigue
- perforated organs
- ectopic pregnancy
Some plaintiffs also report experiencing nausea, vomiting, migraines, difficulty breathing, numbness, and pain during intercourse.
The lawsuit alleges that Bayer Healthcare has known about the serious problems linked with their birth control device, but instead of warning patients and the medical community about these dangers, chose to actively withhold this information, placing company profit over patient safety.
Filing a Essure Complications Lawsuit
Plaintiffs allege that, had they been adequately informed of these Essure side effects, they would never have been implanted with an Essure birth control device and avoided these risks altogether. Some spouses of the female plaintiffs also filed on a count of loss of consortium.
If you or someone you love has suffered from any of these Essure side effects, you may be able to file an Essure complications lawsuit against Bayer.
The Essure Complications Lawsuit is Hines, et al., v. Bayer, et al., Case No. 4:17-cv-01395, in the U.S. District Court for the Eastern Division of the Eastern District of Missouri.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
