A Georgia couple recently filed a lawsuit against Biomet, Inc., alleging that the company’s artificial hip implant was defective and harmful.
Plaintiff Dana B. was implanted with a Biomet M2a Magnum artificial hip device on August 30, 2011, to help with her degenerative joint disease.
Her surgical wounds healed healthily directly after her artificial hip surgery, and she suffered from no apparent complications, according to her complaint.
On March 20, 2012, Dana underwent a second artificial hip implant surgery, this time for her other hip. A M2a magnum artificial hip device was used once again. This second surgery seemed to go well, and no complications were discernible in the immediate aftermath of the surgery.
However, Dana began experiencing pain in her hips a few years later. In March 2015, Dana went to see an orthopedic surgeon about this pain. The doctor found that she had elevated levels of cobalt and chromium metals in her bloodstream.
The orthopedic surgeon advised that she go through hip revision surgery in both of her hips.
At the surgeon’s recommendation, Dana underwent right hip replacement revision surgery first on May 15, 2015. During the procedure, Dana’s doctor found some joint fluid and metal staining. She was then implanted with another Biomet artificial hip.
A short while later, on September 18, 2015, she underwent a second hip revision surgery, this time on her left hip. She was implanted with a ceramic head hip instead of a metal one.
The Biomet hip replacement lawsuit alleges that because these artificial hip implants failed, Dana suffered from severe and permanent injuries.
Because of the pain from these artificial hip devices and the resulting revision surgery she was forced to go through, the lawsuit alleges that she will continue to suffer from these injuries in the future.
Dana also had to pay a variety of financial expenses from medical, hospital, therapy, and pharmaceutical expenses, which will continue indefinitely.
The artificial hip lawsuit claims that, had Biomet not concealed this information and adequately warned the public and the medical community about the risk of failure linked with their product, Dana would have chosen a safer alternative and avoided these complications entirely.
Dana filed this Biomet hip replacement lawsuit on multiple counts, including defective design, failure to warn, negligence, and fraud. Her husband David added a count of loss of consortium to the artificial hip lawsuit.
