A Georgia woman has filed a Denali IVC filter lawsuit, alleging that the Bard product caused complications that led to her mother’s untimely death.
According to the Denali IVC filter lawsuit, Gertie F. was implanted with a Denali IVC filter device on August 21, 2015. The specific device was the Denali Vena Cava Filter, manufactured by CR Bard.
Unfortunately, soon after implantation of the device, Gertie began experiencing serious complications that unfortunately led to her death. The lawsuit alleges that these fatal side effects were a direct result of being implanted with the IVC filter device.
Shirley filed her Denali IVC filter lawsuit on August 23 in the U.S. District Court for the District of Arizona. The suit was filed on multiple counts, including manufacturing defect, failure to warn, design defect, negligence, breach of express and implied warranties, fraudulent misrepresentation and concealment, loss of consortium, and wrongful death, among several others.
The Denali IVC filter lawsuit is part of a larger MDL, or multidistrict litigation, which includes other lawsuits with similar allegations against Bard.
IVC Filter Complications
IVC filter devices, also known as inferior vena cava filters, are medical devices used to prevent blood clots from moving into a patient’s lungs and heart, which can cause serious damage. The filter is implanted into a patient’s main artery, or the vena cava.
IVC filters have become increasingly popular since they entered the market. However, a growing number of reports and lawsuits claim that these devices can themselves cause serious injuries and complications, even causing life-threatening injuries.
Lawsuits likes this Bard IVC filter lawsuit are being filed across the U.S., claiming that the product can be too dangerous for patients—in some cases, more dangerous than the complications they are meant to treat. But patients claim they were not adequately warned about the extent of the danger posed by these devices.
Adverse event reports filed with the U.S. Food and Drug Administration (FDA) in the past decade show that hundreds of patients have suffered from IVC filter side effects from punctured organs to filter migration, causing serious or permanent problems.
Filing a Denali IVC Filter Lawsuit
This Denali IVC Filter lawsuit, and many others like it, claim that Bard and other medical device manufacturers should take responsibility for the devastating side effects their devices have allegedly caused in patients and their families across the country.
Injured patients have filed lawsuits against a number of IVC filter makers, including Bard. These lawsuits cite organ damage due to filter migration and breaks, as well as other serious complications.
If you or someone you know has undergone complications due to retrievable IVC filters, you may have cause to file a Denali IVC filter lawsuit. Filing a lawsuit does not repair the damage and cannot bring a loved one back to life, but it can help to at least compensate for the physical, emotional, and financial losses felt as a result of these devices.
The Denali IVC Filter Lawsuit is Case No. 2:17-cv-02843-DGC, in the U.S. District Court for the District of Arizona.
In general, IVC filter lawsuits are filed individually by each plaintiff and are not class actions.
