Eye drop lawsuit overview:

  • Who: Donna Fike filed a lawsuit against Global Pharma Healthcare Private Ltd., Ezricare LLC, EzriRx LLC, Aru Pharma Inc. and Amazon.com Inc.
  • Why: Fike claims she was forced to have one of her eyeballs surgically removed after contracting a bacterial infection allegedly caused by EzriCare Artificial Tears she says she purchased on amazon.com.
  • Where: The lawsuit was filed in Pennsylvania federal court.
  • How to find help: If you or a loved one suffered from a bacterial infection, vision loss, other injury or death after using EzriCare eye drops, Delsam Eye Drops or Delsam eye ointment, you could join a lawsuit investigation.

A Pennsylvania woman needed to have one of her eyeballs surgically removed after she contracted a bacterial infection from using EzriCare Artificial Tears, an eye drop product she purchased on amazon.com, a new lawsuit alleges.

Plaintiff Donna Fike claims she is among 81 individuals who were infected with pseudomonas aeruginosa bacteria from using the EzriCare Artificial Tears eye drop product, with at least four having their eyeballs removed.

The U.S. Centers for Disease Control and Prevention (CDC) linked pseudomonas aeruginosa bacteria to EzriCare Artificial Tears in May 2022, with EzriCare first acknowledging it was under investigation in January, according to the EzriCare lawsuit.

Fike argues she ultimately needed to have her left eyeball surgically removed and replaced with a plastic implant in February after her attempts to manage the pain and bacterial infection were unsuccessful.

“As a direct and proximate result of the conduct of the Defendants in manufacturing, importing, compounding, packaging, distributing, supplying and marketing of the contaminated EzriCare Artificial Tears, Mrs. Fike has been permanently injured both physically and emotionally,” the Amazon and Ezricare lawsuit states.

FDA issued warning about EzriCare Artificial Tears in February

Global Pharma Healthcare Private initiated a voluntary recall for all unexpired lots of EzriCare Artificial Tears on Feb. 1, while the U.S. Food and Drug Administration warned consumers the next day to stop using the product, according to the eye drop lawsuit.

The loss of Fike’s left eye, meanwhile, caused her “severe pain, suffering, disability, impairment, loss of enjoyment of life, loss of care, comfort and economic damages,” the EzriCare lawsuit alleges.

EzriCare, Amazon and the other defendants are accused of negligent infliction of emotional distress, breach of express warranty, negligence and violating the Pennsylvania Unfair Trade Practices and Consumer Protection Law, among other things.

Fike demands a jury trial and requests an award of compensatory and punitive damages.

A woman filed a similar complaint against Global Pharma Healthcare, EzriCare, EzriRX and Aru Pharma earlier this year, arguing she needed to have her “remaining good eye” removed after she developed a bacterial infection allegedly caused by EzriCare eye drops.

The Ezricare and Amazon eye drop lawsuit is Fike v. Global Pharma Healthcare Private Ltd., et al., Case No. 5:23-cv-02981, in the U.S. District Court for the Eastern District of Pennsylvania.
