A woman has filed a lawsuit against the makers of a popular blood thinner medication alleging her Xarelto GI bleed caused her to sustain injury.
Plaintiff Eva B. filed her lawsuit in Louisiana federal court against plaintiffs Janssen Pharmaceuticals and parent company Johnson & Johnson, Bayer Healthcare Pharmaceuticals and their related companies.
The lawsuit is part of the Xarelto multidistrict litigation that is currently centralized under Judge Fallon in the U.S. District Court in Louisiana.
These lawsuits were grouped together under a single judge due to the similar nature of the claims in order to conserve resources during pretrial proceedings.
Currently, there are nearly 15,000 actions pending in the Xarelto MDL.
Xarelto GI Bleed Lawsuit Joins MDL
Eva began taking Xarelto in 2014 until 2015 under the direction of her physician to treat blood clots, according to the lawsuit.
In addition to being used as a treatment and prevention for blood clots, Xarelto is also used to reduce the risk of stroke and systemic embolism in patients with atrial fibrillation, an abnormal heart rhythm.
It is also prescribed to treat and reduce the risk of deep vein thrombosis and pulmonary embolism and is used preventively to guard against deep vein thrombosis in patients undergoing knee and hip replacement surgery.
“Upon information and belief, and as a direct and proximate result of the use of Defendants’ Xarelto, Plaintiff experienced gastrointestinal bleed on or about January 2015 thereby suffering a life-threatening, irreversible bleed from the use of Xarelto, and was caused to sustain severe and permanent personal injuries, pain, suffering, and emotional distress,” the lawsuit states.
These serious side effects included life-threatening bleeding, physical pain and mental anguish, financial expenses for hospitalization and medical care and resulted in diminished enjoyment of life.
The lawsuit goes on to state that the full results of Xarelto clinical trials were not adequately presented to physicians and patients, and specifically neglected to highlight the increased risk of bleeding of Xarelto over a competing drug, warfarin.
Eva’s complaint also states that a lack of antidote to reverse bleeding in patients taking Xarelto was not provided in the warning section of the drug’s label.
The plaintiff has brought forth a number of counts against the manufacturers including negligence, strict products liability, breach of express warranty, breach of implied warranties, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, fraud and deceit, violation of consumer protection laws and punitive damages.
Eva is seeking relief in the form of compensatory damages for her pain, suffering, emotional distress and loss of enjoyment of life, economic damages for medical expenses, lost earnings and other economic damages, punitive or exemplary damages, pre-and post-judgment interest, attorneys’ fees and costs and any additional relief deemed just and proper by the Court.
