A woman who underwent Zimmer knee replacement surgery joined an MDL filed against Zimmer after allegedly suffering knee replacement complications from the Zimmer NexGen LPS-Flex.
Plaintiff Debby T. initially filed her lawsuit in 2012 following serious complications with her Zimmer knee replacement. The Florida resident underwent knee replacement surgery in her left knee in 2011. According to the knee replacement lawsuit, she “has suffered injures as a result of implantation … of the Zimmer NexGen Knee device.” ‘
The Zimmer knee MDL places the blame on the manufacturer as neither Debby “nor their physicians, through the exercise of reasonable diligence, could have detected the defective nature of the Zimmer NexGen Knee device any earlier than the evidence of loosening and/or other indication for planned revision of the defective device,” said the knee replacement lawsuit.
Counts include design defect, failure to warn, manufacturing defect, negligence, misrepresentation, breach of warranty, loss of consortium, violation of consumer protection statutes, and punitive damages.
Additional Knee Replacement Lawsuits
Many manufacturers are facing knee replacement lawsuits after replacement surgeries failed and caused severe pain to the patient. Knee replacement complications may include:
- Premature loosening
- Severe pain
- Inflammation and swelling
- Limited mobility
- Infection
- Bone, join, muscle or neurological damage
Manufacturers currently involved in knee replacement lawsuits include OtisKnee, Stryker, Smith & Nephew, and DePuy. Some manufacturers have multiple models which have failed.
Knee replacement surgery is extremely painful. Many of these newer models such as the Zimmer knee replacement system were designed to be more natural. They were to be custom-fit to an individual, limit recovery time, and use more of the original bone. Had this worked, knee surgery might have improved.
Instead, many patients have claimed that their knee replacements failed and were forced to undergo additional revision surgery.
Knee replacement lawsuits have been filed in order to win compensation for individuals who have suffered due to the alleged negligence of manufacturers. Plaintiffs may receive money for their pain and suffering, medical care, and other expenses and awards.
The Zimmer Knee MDL was created in order to consolidate the multiple claims filed against Zimmer. MDLs, or multidistrict litigations, are sometimes used to make the legal process run more efficiently. By grouping lawsuits making similar claims, an MDL can avoid unnecessary duplication of effort.
This Zimmer Knee MDL is In Re: Zimmer NexGen Knee Implant Products Liability Litigation, MDL No. 2272, in the U.S. District Court for the Northern District of Indiana, South Bend Division.
In general, knee replacement lawsuits are filed individually by each plaintiff and are not class actions.
