A North Carolina woman recently filed an intracranial hemorrhage lawsuit against Janssen Pharmaceuticals, alleging that exposure to the company’s blood thinner medication Xarelto led to her husband’s untimely death.
The plaintiff, Deborah R., filed the intracranial hemorrhage lawsuit on behalf of her late husband, Curt R. According to the lawsuit, Curt took Xarelto for a period of about a year, between October 2016 and September 2017, eventually leading to his suffering from an intracranial hemorrhage and subsequent death the next day. The intracranial hemorrhage lawsuit alleges that these injuries were a direct result of exposure to Xarelto.
Deborah claims that her late husband was not adequately warned of the risks associated with Xarelto, including intracranial hemorrhage and that, had he known, he would have chosen a safer alternative. Instead, the plaintiff claims, Janssen chose to actively promote Xarelto as safe and effective, while concealing the major risks associated with the drug. The plaintiff claims that Janssen’s actions show “flagrant, willful, and depraved indifference to health, safety, and welfare.” Ultimately, she claims, this led to Curt’s injuries and subsequent death, the lawsuit alleges.
Deborah filed her intracranial hemorrhage lawsuit on July 18, 2018, in the U.S. District Court for the Eastern District of Louisiana. The intracranial hemorrhage lawsuit was filed on multiple counts, including strict liability, manufacturing defect, design defect, failure to warn, negligence, breach of express and implied warranties, fraud, and several others.
Background of Xarelto
Xarelto (also known by its generic name, rivaroxaban) is a relatively new blood thinning drug. Xarelto is manufactured and sold by Janssen Pharmaceuticals, a prominent subsidiary of pharmaceutical giant Johnson & Johnson. Since it was first introduced to the market, Xarelto has become increasingly popular.
Xarelto is prescribed to treat blood clots and conditions related to clotting. Blood clots can be very dangerous, and in some cases can be fatal, which makes the use of new blood thinner drugs like Xarelto so widespread.
