Bayer Healthcare has been hit with yet another Mirena lawsuit, this time filed by a California woman alleging the implant led to her diagnosis with pseudotumor cerebri
The plaintiff, Rosanna K., was implanted with a Mirena birth control device in Dec. 2006, replacing it with another Mirena device in March 2011. Unfortunately, Rosanna alleges she later began experiencing complications related to the device, developing symptoms of a condition known as pseudotumor cerebri. Rosanna says she was diagnosed with pseudotumor cerebri, also known as intracranial hypertension, on Oct. 2, 2017.
Rosanna alleges that her injuries were directly caused by a defective Mirena implant. Rosanna turned to litigation against Bayer, alleging that she was not given adequate warning about the risks associated with the device, and that the safety of Mirena use was misrepresented.
Rosanna filed her Mirena lawsuit on March 15, 2018 in the U.S. District Court for the Southern District of New York. The Mirena lawsuit was filed on multiple counts, including negligence, design defect, failure to warn, breach of express and implied warranties, and several others.
Basics of Mirena
The Mirena birth control implant is manufactured by Bayer Healthcare and approved by the U.S. Food and Drug Administration (FDA) less than a decade ago, in 2009. It is a small, flexible IUD implanted in the uterus as a long-acting form of birth control. The Mirena implant slowly releases a birth control hormone called levonorgesterel into a person’s uterus.
Mirena Complications
Any medical device or medication will come with certain side effects. However, Mirena has been linked with pseudotumor cerebri (PTC) via reports and studies, but the risk of PTC is not included on the warning label for the product.
Pseudotumor cerebri, or “false brain tumor,” is so named for exhibiting many of the symptoms of brain tumors without actually being a real tumor. While it is not a tumor, PTC is actually a serious condition characterized by an abnormal and potentially dangerous amount of pressure in a person’s skull. In many cases, medications can reduce the damaging pressure, but in other cases, surgery is required.
Mirena side effects like pseudotumor cerebri may be able to affect a large number of patients, given the popularity of Mirena and other IUD devices. Approximately 150 million people across the globe use IUDs.
Filing a Mirena Lawsuit
Some patients have filed a Mirena lawsuit against Bayer for failing to warn in their advertising or labeling of the potential risk of developing serious Mirena side effects like pseudotumor cerebri because of the device.
