vaginal mesh lawsuitAn Oklahoma woman has joined multidistrict litigation (MDL) against Ethicon Inc. after she allegedly experienced severe negative side effects from their vaginal mesh product. This is one of many vaginal mesh lawsuits filed against Ethicon and other vaginal mesh manufacturers as countless women have reported vaginal mesh complications across the country.

Plaintiff Victoria R. had the Ethicon TVT-Abbrevo mesh implanted in November 2013 in a hospital in Oklahoma. Vaginal mesh is used to treat pelvic organ prolapse. Following the surgery, she experienced vaginal mesh complications. Victoria and other victims may have experienced one or more of the following vaginal mesh complications:

  • Pain during sex
  • Urinary problems
  • Multiple occurrences of pelvic organ prolapse
  • Vaginal scarring
  • Perforated bladder, perforated bowl or perforated blood vessels
  • Mesh erosion into the vagina
  • Infection
  • Organ injuries

Many women, like Victoria, have had to undergo additional mesh surgery in order to have the vaginal mesh removed. In addition to TVT mesh products such as the bladder slings and vaginal slings have also been named in vaginal mesh lawsuits.

This vaginal mesh lawsuit against both Ethicon and Johnson and Johnson includes counts of negligence, manufacturing defect, failure to warn, defective product, design defect, common law fraud, fraudulent concealment, constructive fraud, negligent misrepresentation, negligent infliction of emotional distress, breach of warranty, violation of consumer protection laws, gross negligence, and unjust enrichment.

Vaginal Mesh Lawsuits

Vaginal mesh lawsuits claim that manufacturers such as AMS, Bard, Ethicon, Boston Scientific and others were negligent in their design and production of vaginal mesh products. It has been suggested that there is no real benefit for the products in the first place since it does not adequately treat pelvic organ prolapse. Instead, women are being put at risk for painful side effects.

These numerous claims have already been made by thousands of women across the country. Already, millions of dollars have been paid in settlements to victims of vaginal mesh complications as more vaginal mesh lawsuits are filed and more evidence of the dangers of the products arise. Wrongful death lawsuits may also be filed if you lost a loved one due to vaginal mesh complications with Ethicon’s TVT mesh, Gynemesh, Prolene Soft Mesh, or any of the other products under investigation. Plaintiffs may also file for loss of consortium if the product caused them to experience loss of intimacy with their spouse.

This Vaginal Mesh Lawsuit is Case No:2:15-cv-02112 and  joins the larger Vaginal Mesh MDL In Re: Ehticon Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2327, in the U.S. District Court for the Southern District of West Virginia, Charleston Division.
