A Kentucky resident files a lawsuit against Bayer Corporation due to permanent Essure injuries suffered and severe adverse effects and complications.
According to the permanent Essure injuries lawsuit, plaintiff Shayla H. alleges that she “would not have consented to undergo the Essure procedure” had she known of the medical risks, hazards and serious dangers of undergoing the procedure.
The permanent Essure injuries lawsuit maintains that in July 2013, she underwent an Essure procedure at Regional Medical Center located in Frankfort, Ky. At the time of her procedure, she was 21 years old.
She alleges, according to the permanent Essure injuries lawsuit, that at first the Essure device was inserted and deployed, but no coils could be seen. As the coils seem not to have deployed upon withdrawal, a second attempt was made. Purportedly on this attempt the entire coil ended up in the uterus.
According to the permanent Essure injuries lawsuit, the right side coil was inserted, but the left was removed with a hysteroscopic grasper.
The permanent Essure injuries lawsuit and Shayla maintain that she was told that Essure was “less invasive, with no cutting, and required no downtime compared to tubal ligation.”
She alleges that after the procedure, she suffered severe adverse effects and complications.
According to the complaint, she experienced “pelvic pain, excessive bleeding, dyspareunia, joint pain, hair loss, weight gain, fatigue, abdominal pain, and frequent vaginal infections…” The lawsuit goes on to maintain that in March 2015 she was presented with symptoms of a urinary tract infection.
She claims that she is still being treated for symptoms related to Essure. Although she still has Essure implanted, she wants to have it removed.
Essure Facts
Hundreds of patients have filed lawsuits against Bayer Healthcare due to Essure birth control problems.
Essure is a permanent, non-surgical birth control device that has been highly popular and a great alternative to women instead of tubal ligation. The only permanent form of birth control before Essure’s approval was tubal ligation.
Essure was approved by the U.S. Food and Drug Administration in 2002 under its original manufacturer, Conceptus. It was approved through the federal agency’s fast track program.
During the Essure procedure, two small metal coils are inserted in through the vagina and uterus and placed within a woman’s fallopian tubes. Once in place, and over the next few months, the coils become surrounded by tissue which block the tubes. Soon after, a woman checks in with her physician to confirm that she has permanent birth control and is officially sterile.
Hundreds of women, however, who have had the Essure birth control procedure have filed lawsuits due to adverse effects and serious complications that have resulted from its implantation.
These women say they have suffered from adverse effects and complications including and not limited to: severe pain, discomfort, heavy menstrual bleeding, chronic pelvic pain, chronic back pain, abdominal bloating, abdominal pain, excessive weight gain, dental problems, excessive hair loss, and chronic fatigue.
The Essure Injuries Lawsuit is Case No. 2:17-cv-04555-JP, in the U.S. District Court for the Eastern District of Pennsylvania.
In general, Essure lawsuits are filed individually by each plaintiff and are not class actions.
