A California resident recently filed a lawsuit against DePuy, alleging the company’s Zimmer Durom hip implant caused major complications.
The plaintiff, Delilah B., says she was implanted with a Zimmer Durom hip implant on Sept. 11, 2007. Though the initial surgery went well and healed without infection, she alleges she later began to experience severe complications, including pain and extreme weakness in her hips.
In her lawsuit, Delilah alleges that these complications are the direct result of the Zimmer Durom hip implant device being defective, and claims that she was not adequately warned about its risks. The injuries she suffered were beyond the possible complications she was led to expect, she claims.
The lawsuit claims that prominent California surgeon Dr. Lawrence D. Dorr warned Zimmer in 2007 that patients implanted with the Zimmer Durom hip implant device were suffering from complications that necessitated surgery. Delilah says Dr. Dorr informed Zimmer that the device failed due to separation or loosening from its position, causing crippling pain.
Despite this warning, the lawsuit claims, the company continued to sell its Zimmer Durom hip implant, misrepresenting its safety and efficacy to patients.
The Zimmer Durom hip implant lawsuit was filed on May 29, 2018 in the U.S District Court for the Northern District of California. The lawsuit was filed on multiple counts, including negligence, breach of express and implied warranties, design defect, failure to warn, and more.
The Zimmer Durom Hip Implant Device
The specific device referred to in this lawsuit is the Zimmer Durom hip implant, a metal-on-metal device made of cobalt chromium. The Durom Cup component is made to be permanently fixed in place through bone ingrowth into the cup’s shell.
Though the manufacturer markets its Zimmer Durom hip implant device as safe and effective, hip replacement lawsuits allege that the company is aware of the link between its device and a number of hip replacement problems, including metallosis, device loosening, and a high rate of device failure.
Filing a Lawsuit Over Zimmer Durom Hip Implant Complications
Lawsuits claim that the Zimmer Durom hip implant device’s manufacturers failed to adequately warn the public and the medical community about the complications associated with the device.
The Zimmer Durom hip implant is not the only hip replacement device linked with major complications. Other DePuy implants like the Pinnacle device have been connected with such side effects, and have sparked hundreds or even thousands of lawsuits. In response to reports of DePuy Pinnacle side effects, Australia has already taken the Pinnacle hip device off their medical market.
If you or someone you love has experienced hip replacement problems due to Zimmer Durom hip implant defects or complications caused by another hip implant, you may be able to file a lawsuit. While filing a lawsuit cannot take away the pain and suffering caused by these device defects, it can help to alleviate the financial burden caused by medical expenses and lost wages.
The Zimmer Durom Hip Implant Lawsuit is Case No. 4:18-cv-03189-KAW, in the U.S. District Court for the Northern District of California.
