Widow Files Lawsuit Alleging Asbestos Products Led to Late Husband’s DeathA Delaware woman recently filed a lawsuit against Asbestos Corporation and a number of construction companies, alleging exposure to products made with the company’s asbestos led to the death of her husband from mesothelioma.

The plaintiff, Judith B., filed this lawsuit on behalf of her late husband, Jack B. According to the lawsuit, Jack was exposed to asbestos products in the course of his work from a number of manufacturers and at a number of different employers.

Through the years, the lawsuit alleges he was exposed to asbestos products at the following occupations: his father’s carpentry business, a machinist mate for the U.S. Navy, and an operator and mechanic for DuPont. The lawsuit claims that Jack’s exposure to these dangerous asbestos products could have been prevented, but he was not adequately warned about or protected from this exposure.

Jack’s exposure to these asbestos products allegedly led to his development of mesothelioma, ultimately causing his untimely death on June 8, 2017. Before his death, the lawsuit claims, Jack suffered from physical and emotional pain, and also underwent substantial medical treatment and incurred serious financial expenses.

Judith filed her asbestos products lawsuit on July 12, 2018, in the Superior Court of the State of Delaware. The lawsuit was filed on multiple counts, including strict liability, willful an wanton conduct, conspiracy, and loss of consortium.

Background of Asbestos Products

Asbestos is a naturally-occurring mineral that used to be popular for commercial purposes such as electrical or building insulation, as well as countless others because of its flame-retardant abilities. However, the material is now known to be hazardous to human health, and regulations regarding the use of asbestos have been in place for decades. Asbestos exposure can cause several serious health problems, including mesothelioma cancer.

In many cases, malignant mesothelioma can take decades for symptoms to appear. Unfortunately, it is often diagnosed when it has reached its later and more dangerous stage of development. Even though the use of asbestos has been heavily regulated in the last few decades, this delay means that those exposed to asbestos decades ago are only now being diagnosed with life-threatening cancer.

Filing an Asbestos Lawsuit

If you or someone you love has been diagnosed with or died from an asbestos-related disease like mesothelioma cancer after occupational exposure to asbestos products, you may be able to file an asbestos products lawsuit. Spouses of those affected, like Judith, who filed this lawsuit, may also be able to file over loss of consortium.

While filing an asbestos lawsuit over malignant mesothelioma diagnosis cannot take away the pain and suffering caused by the disease, or bring a loved one back to life, if successful, it can help to alleviate the financial burden incurred by medical bills and lost wages.

The Asbestos Products Lawsuit is Case No. 1:18-cv-01029-UNA, in the Superior Court of the State of Delaware.
