An asbestos cancer lawsuit was recently filed in Washington State Court against several defendants including Air & Liquid Systems Corporation, A.W. Chesterton Company, and several other companies, alleging that the defendants exposed the plaintiff to asbestos and asbestos products, causing him to develop mesothelioma.
Plaintiffs Paul and Rita M., a married couple who reside in Port Orchard, Washington filed the asbestos exposure lawsuit after Paul was diagnosed with mesothelioma in December 2015.
The couple claims that Paul was subjected to asbestos exposure during his employment as a wireman helper for several different companies between 1953-1957 and while working at the Puget Sound Naval Shipyard and several home remodeling projects during the 1970’s.
According to the asbestos cancer lawsuit, Paul asserts the defendants are responsible based on the theories of negligence, product liability, conspiracy, willful or wanton misconduct, breach of warranty, and several other theories.
Paul is asking for damages to cover his medical expenses, pain, disability and other economic losses. Paul’s wife, Rita, is bringing a claim for loss of consortium, a claim often brought by a victim’s spouse that alleges a loss of spousal relationship.
What is Asbestos?
Asbestos is a toxic, naturally occurring, fibrous mineral. Asbestos is a heat resistant mineral that is used for fire-resistance and insulating materials. Due to these qualities the US Military and several other industries have heavily relied on asbestos products.
Certain occupations are at a greater risk of asbestos exposure. Some of these occupations include roofers, shipyard workers, textile workers, toll collectors, US Navy, and the US Military. Many of the workers do not realize their risk of asbestos exposure.
Asbestos Cancer
Exposure to asbestos can cause serious types of cancers such as mesothelioma and asbestos lung cancer. Asbestos lung cancer is a rare but serious disease that often results in death. Asbestos exposure can develop into lung cancer when asbestos fibers are released into the air and inhaled. If inhaled the fibers become trapped in the lungs. These particles remain in the lungs for a long period of time and cause inflammation, scarring and other critical problems.
According to the website asbestos.com, the size of the asbestos fibers and the location of the fibers in the body often determine whether or not mesothelioma or asbestos cancer develop. Symptoms of mesothelioma and asbestos cancer often take several years to develop after asbestos exposure has occurred. Once symptoms do develop the cancer often spreads quickly throughout the body.
