Walmart prices class action lawsuit overview:
- Who: Vassilios Kukorinis filed a class action lawsuit against Walmart Inc.
- Why: Kukorinis claims Walmart uses its point-of-sale system to artificially inflate the weight of sold-by-weight and similar products it sells to charge a higher price than what is advertised.
- Where: The class action lawsuit was filed in Florida federal court.
Walmart artificially inflates the weight of grocery items, bagged produce, clearance items and seafood products it sells to charge customers more than their lowest advertised price per pound/ounce, a new class action lawsuit alleges.
Plaintiff Vassilios Kukorinis claims Walmart, through its point-of-sale (POS) system, “deceptively, systemically and artificially increases the weight of the product at checkout, resulting in the Customer paying an inflated price.”
Walmart effectively deceives its customers into paying more at the register than what the company advertises as the price per pound affixed as a price sticker to the product, the inflated Walmart prices class action claims.
“Walmart uses unfair and deceptive business practices to deceivingly, misleadingly and unjustly pilfer, to Walmart’s financial benefit, its customers’ hard-earned grocery dollars,” the lawsuit states.
Walmart class action alleges retailer programs POS system to ‘falsify weights’
Walmart’s POS system software has been programmed to “falsify weights, unit prices and ultimate product prices,” the Walmart class action alleges.
Kukorinis argues further that “that the frequency and consistent pattern of the falsification practices are not mere errors. Rather, they are symptomatic of a programmed fraudulent scheme.”
Kukorinis claims Walmart is guilty of unjust enrichment and in violation of Florida’s Deceptive and Unfair Trade Practices Act as well as multiple state consumer protection statutes.
He demands a jury trial and requests injunctive and declaratory relief along with an award of actual, compensatory and punitive damages for himself and all class members.
Kukorinis wants to represent a nationwide class and Florida and multistate consumer protection subclasses of individuals who have purchased a sold-by-weight, bagged produce or clearance product from Walmart and paid a higher price than what was advertised.
A consumer filed a separate class action lawsuit against Walmart last month, arguing the company unlawfully collects and uses the biometric data of its customers without obtaining their consent.

This happens at Sam’s Club too. When dividing out ground beef I have found that the package shows 9.93 lbs, however, there was only 9.1.lbs in the package. At $3.48/lb that adds up quickly.

I live in Virginia, I have noticed cashiers ring up the same item 3 time when you only had 1. I have seen them ring up and item that wasn’t in my cart. They have removed most of the price labels, all of the price checkers and it seems like they don’t want you to know the real prices. Their prices per item have consistently Increased but I no longer think it’s inflation it’s greed and bait and switch. The price check app is inconvenient and still gives me the wrong price at times. I bought a duster that was labeled $11.58 and it rang up as 14.88. most people only shop there because of convince or lack of funds. At this point I hate Walmart and am looking for a better store if there is a class action suit, please allow us to sign up

Walmart ripping us off!! This is happening more times than not. I was charged $10 for a container of cool whip. So I had to make another trip into town to return it.

Add me. I complained to Walmart on Facebook about the prices on the shelves being higher at the register and they basically said “sorry” and that a manager would contact me within 3 days. It’s been weeks with zero contact.
