A new class action lawsuit claims Vince Camuto has been secretly tacking on fees to consumers’ online orders without their consent.
Plaintiff Rachel Scott filed the class action complaint against Camuto IPCo, LLC, which does business as designer brand Vince Camuto, on June 20 in California federal court, alleging violations of state and federal consumer laws.
Scott alleges in the lawsuit that Vince Camuto automatically adds a “Route Package Protection” fee to all orders placed on its website without consumers’ consent.
She claims the company’s use of “dark patterns” is deceptive and unfair, as it tricks consumers into paying for a service they never agreed to purchase.
“Vince Camuto hides, disguises, and fails to divulge that a ‘Route Package Protection’ Fee will be automatically added to all orders to deceive consumers into purchasing it,” the Vince Camuto shipping fees class action lawsuit claims.
Class action: Vince Camuto’s checkout process is designed to mislead consumers
The lawsuit alleges the company allegedly adds the fee at the final payment screen without consumers’ knowledge or consent.
Scott claims consumers never affirmatively choose to add the “Route Package Protection” to their shopping cart; instead, Vince Camuto allegedly adds the fee automatically right before the purchase is complete.
“Many consumers do not notice that an additional fee is being added to their order,” the lawsuit alleges. “Others believe that they have no choice but to pay this fee. And others still notice the previously undisclosed fee but decide to go through with the purchase anyway: they have already invested substantial time and effort inputting their information into Defendant’s system.”
Scott wants to represent a nationwide class of consumers who ordered products from vincecamuto.com and were assessed a “Route Package Protection” fee.
She is suing for unjust enrichment and violations of California’s Unfair Competition Law, False Advertising Law and Consumer Legal Remedies Act. She is seeking certification of the Vince Camuto shipping fees class action lawsuit, damages, restitution, fees, costs and a jury trial.
In another “junk fees” class action lawsuit, World Market is accused of adding fees on purportedly oversized items and additional handling fees.
