Ethicon (a subsidiary of Johnson & Johnson) is accused of fraudulently concealing the dangers of transvaginal mesh devices and violating consumer protection laws.
A vaginal mesh lawsuit filed by Virginia resident plaintiff Deborah B. alleges that the vaginal mesh device (Vaginal Promisa Ethicon Mesh) implanted surgically in December 2011 was defective and dangerous. In 2013, Deborah allegedly began experiencing mesh pain and approximately six months later underwent an invasive revision surgery to remove the vaginal mesh device.
According to the Ethicon vaginal mesh lawsuit, Deborah asserts that Ethicon negligently manufactured and sold defective and unreasonably dangerous vaginal mesh products, withholding information from consumers and the medical community about the risk that transvaginal mesh may erode through the vagina, causing infections and other injuries.
Deborah is seeking compensatory, general and special, and punitive damages for Ethicon and Johnson & Johnson’s alleged gross negligence and failure to warn.
Vaginal Mesh Complications
Problems with transvaginal mesh or bladder sling systems have caused thousands of women throughout the United States to suffer severe injuries after surgery to repair pelvic organ prolapse or stress urinary incontinence.
Some of the first vaginal mesh products introduced in the United States were made by Ethicon.
Most of these vaginal mesh devices were approved under the FDA’s controversial 510(k) Premarket Notification System, which allows the manufacturer to start selling the product without vigorous premarket testing when they establish that it is substantially equivalent to something else that has already been approved.
In recent years, the FDA has received reports of thousands of problems with Ethicon vaginal mesh systems as well as those made by other companies. Tens of thousands of women are now pursuing transvaginal mesh lawsuits after experiencing painful vaginal mesh complications from Ethicon mesh devices.
Not only do these vaginal mesh products pose a risk of serious complications, there is no evidence that transvaginal insertion of a bladder sling or mesh device provides any benefit over other available treatments for pelvic organ prolapse.
Transvaginal Mesh Lawsuits
As a result of the manufacturer’s alleged failure to adequately research the products or warn about the serious risk of problems and complications, compensation may be available through an Ethicon vaginal mesh lawsuit.
