Thousands of vaginal mesh lawsuit have been flooding in, with victims claiming that the pelvic mesh device caused serious side effects which they weren’t warned about.
An Ohio woman, Rita Miller, is one of the most recent plaintiffs, filing her vaginal mesh lawsuit on Dec. 30, 2013. Specifically, Miller is suing Ethicon Inc. and Johnson & Johnson, although a number of other vaginal mesh makers have been targeted in lawsuits. Some of the other companies include Ethicon LLC, Boston Scientific Corporation, American Medical Systems, Sofradim Production SAS, CR Bard, Coloplast Corp., Cook Biotech, Cook Incorporated, Cook Medical Inc. and Mentor Worldwide LLC.
The vaginal mesh complications cited in these lawsuits can be permanent and life-altering. For example, some women claim that the scarring from vaginal mesh erosion leads to infertility or the ability to have pleasurable sex. There are vaginal mesh lawsuits where couples divorce, both citing the vaginal mesh complications as the cause.
Infertility can be especially heartbreaking for women who haven’t had biological children yet, or those who wanted to have more children. In addition to these extreme complications, there are sometimes multiple surgeries required to try to remove remnants of the mesh, and at times it’s impossible to remove all of it. These procedures can be dangerous, painful and expensive.
Some women claim that they had no symptoms that anything was wrong with their pelvic mesh, and they weren’t aware of the situation until it became extreme. Other women recall pain and being uncomfortable with the mesh, sometimes for months. Women without health insurance especially might face insurmountable medical debt.
Victims like Miller claim that they were never warned about the risks of vaginal mesh complications, or that they were underwarned.
Another common complaint is that the benefits don’t outweigh the risks. The purpose of these devices is to treat incontinence or pelvic organ prolapse (POP). While both of these situations can be uncomfortable and/or embarrassing, the women claim that the high risk of hazards, which they allege they weren’t told about, aren’t worth it. Their physicians also didn’t warn them about vaginal mesh issues that may arise, since doctors also depend on medical device makers for transparency. According to legal claims, the numerous makers of these devices knew about the risks, but chose not to make them known to the medical community, doctors or their patients. There were allegedly no warnings on any information sheets, advertising, or on materials included with the device themselves.
Numerous Counts
Miller has cited numerous counts against the Ethicon, including negligence, manufacturing defect, failure to warn, defective product, design defect, common law fraud, fraudulent concealment, constructive fraud, negligent misrepresentation, negligent infliction of emotional distress, breach of warranties, violation of consumer protection laws, gross negligence, unjust enrichment, punitive damages and discovery rule and tolling.
