A new class action lawsuit accuses United Parcel Service of collecting tariff charges and increasing shipping costs based on tariffs that were declared illegal by the Supreme Court.
Plaintiff Hali Anastopoulo filed the class action complaint against UPS on Feb. 20 in Georgia federal court, alleging violations of state and federal consumer laws.
According to the class action lawsuit, the Supreme Court ruled on Feb. 20 that certain tariffs imposed under the International Emergency Economic Powers Act (IEEPA) were illegal.
Before that ruling, UPS imposed tariff charges and increased shipping costs on customers, including Anastopoulo, based on those now-invalid tariffs, she says.
Anastopoulo claims she paid these increased charges as part of shipping costs for goods transported by UPS. Because the underlying tariffs have been declared illegal, she seeks recovery of amounts collected by UPS that were based on or attributed to those unlawful tariffs.
The class action lawsuit seeks to represent anyone in the United States who paid unlawful tariff charges to UPS under the IEEPA.
UPS ‘unjustly enriched’ by collecting tariff charges, class action claims
Anastopoulo claims UPS charged her and class members additional fees, surcharges, duties and tariff charges purportedly imposed under the IEEPA.
By charging and collecting unlawful tariff charges, UPS breached the express terms of its shipping contracts, she alleges.
The class action lawsuit alleges UPS was unjustly enriched by collecting and retaining charges derived from tariffs that were subsequently declared unlawful.
Anastopoulo is suing for breach of contract and unjust enrichment and is seeking certification of the UPS class action, damages, fees, costs and a jury trial.
