Unum Life Insurance Company of America is facing new allegations from a Washington woman, claiming the company wrongfully denied her disability benefits.
The Unum lawsuit alleges the insurance company reviewed her claim or disability with an unfair bias, and ignored important medical testimony when making their final decision.
Plaintiff Ara B. is filling this Unum lawsuit after being denied her disability benefits when she was supposed to be fully covered through her employment.
Previously employed by Via Radiology, Ara was provided with long term disability coverage and life insurance waiver of premium benefits. In addition to being the insurance provider, Unum is primarily responsible for determining whether or not any claims from Ara would be approved or denied.
After becoming disabled due to certain problems, Ara was forced to stop working after becoming unable to perform her occupational duties. Furthermore, Ara has been unable to work in a similar job or find sufficient income due to her disability.
Unum Lawsuit Alleges Wrongful Claim Denial
According to the Unum lawsuit, Ara has lost a significant amount of her income and has met all requirements to be eligible for long term disability and life insurance waiver premium benefits from the insurance company.
Even though Ara met all requirements and followed administrative procedures when filing the claim, Unum still denied her disability benefits.
Unum’s Practice of Denying Disability Insurance Claims
Unum is one of the largest disability insurance providers in the world and has disability insurance policies with approximately 17 million Americans.
However Unum has gained an infamous reputation for denying insurance claims based on faulty information and ignoring medical testimony from the policyholder’s physician.
The insurance company has also been accused of developing specific strategies to deny disability coverage claims, including changing policies after the claims are filed or obtaining opinions from third party experts.
Other tactics allegedly used by Unum include not acknowledging the policyholder’s disability and arguing the disability is a pre existing condition.
Unum is obligated to insure that a fair and unbiased review is conducted on each of these claims, as their policyholders rely on the benefits they receive to sufficiently cover lost income or expensive medical costs.
The Unum lawsuit alleges the insurance company ignored relevant medical testimony, and based their decision on false or biased claims from unreliable sources.
At this point in time, Ara has exhausted all administrative options and has been forced to resort to file an Unum lawsuit. Ara is seeking compensation for all missed payments and is calling for her claim to have a “full and fair” review.
The Unum Lawsuit is Case no. 6:17-cv-00097-BHH in the U.S. District Court for the District of South Carolina, Greenville Division.
