Disability-insurance-denial-lawsuitA North Carolina plaintiff recently joined the growing number of consumers filing disability insurance denial lawsuits against Unum over unfair denial.

Plaintiff Susan S. worked for PeopleFluent as an administrative assistant up until she became disabled and stopped work on Feb. 28, 2017.

Susan has been diagnosed with a number of conditions that prevent her from performing her duties as an administrative assistant. These conditions include lumbar disc disease with radiculopathy, degenerative joint disease in the spine, sciatica, and supra ventricular tachycardia, her Unum lawsuit claims.

Working with PeopleFluent gave Susan coverage under a long-term disability plan from Unum. However, when she filed to receive her long-term disability benefits, Unum issued a disability insurance denial.

At first, Susan attempted to appeal the disability insurance denial, but Unum upheld its original decision.

After attempting all available administrative means to fight Unum’s disability insurance denial, Susan turned to litigation, joining thousands of others who have also filed Unum lawsuits over unfair disability insurance denial.

Indeed, Susan’s situation is far from a solitary occurrence. Many patients have been denied long-term disability benefits and claim that the denial was improper. Many plaintiffs suffering from disabling conditions have filed disability insurance lawsuits against Unum after being denied these benefits.

Plaintiffs allege that Unum Life Insurance may choose to issue an unfair disability insurance denial in order to place company profit over patient health and safety. Since Unum is the insurer as well as the administrator of the plan, plaintiffs argue that this creates a conflict of interest where the company is unable to objectively grant or deny disability insurance to consumers covered under their plans.

Filing a Disability Insurance Denial Lawsuit

A growing number of plaintiffs are filing disability insurance denial lawsuits against Unum, claiming that the insurance giant unfairly denied their claims to benefits that they qualify for under the terms of their insurance policies.

Susan’s Unum lawsuit and others like it allege that Unum, as the largest disability insurance company in the country, has unfairly denied the disability insurance claims of plaintiffs who are qualified to receive such benefits. Some plaintiffs go further, alleging that the company purposely denied the claims of hundreds of thousands of workers with legitimate disabilities for no reason other to increase the company’s profit.

Former employees of Unum have even reported that they were instructed to purposely deny insurance to people with legitimate claims to disability benefits in order to fulfill the company’s quota.

Consumers who have exhausted all recourse through applications and appeals for disability benefits may turn to filing a disability insurance lawsuit over denied disability benefits, hoping to reverse Unum’s denial.
