Unum-disability-insurance-denialAfter experiencing an Unum disability insurance denial over long-term disability benefits, a South Carolina woman has taken matters into her own hands, filing a lawsuit against Unum.

The plaintiff, Barbara H., was an employee of Electrolux up until May 2015, and was covered by a disability insurance plan via Unum Life Insurance Company of America.

According to Barbara’s lawsuit, she became disabled and was no longer able to continue her work, prompting her to file a claim for long term disability benefits under her insurance plan provided through her employer and Unum.

Unfortunately, Barbara received notice of her Unum disability insurance denial in July 2016.

She did not give up at that point, filing an appeal against the Unum disability insurance denial in September 2016. However, the plaintiff received a final Unum disability insurance denial letter on December 5, 2016.

The initial insurance claim and subsequent appeal exhausted Barbara’s available administrative means of fighting for her disability insurance. At this point, the plaintiff had but one option left: the route of litigation in the form of an insurance denial lawsuit.

Barbara’s Unum lawsuit alleges that Unum failed to conduct a “full and fair review” of her insurance claim. The lawsuit requests that the court conduct their own review of her claim instead, and requests an award covering the attorney’s fees incurred by pursuing litigation.

Filing an Unum Disability Insurance Denial Lawsuit

Unum Life Insurance Company of America, more commonly known simply as Unum, is the single largest disability insurance company in the United States.

A growing number of plaintiffs like Barbara H. are filing disability benefits lawsuits against Unum after being denied insurance.

These lawsuits allege that the insurance giant gave plaintiffs an unfair Unum disability insurance denial with regard to their claims to benefits that they qualify for under the terms of their insurance policies.
