A former employee and manager at Burger King filed a lawsuit against Unum for denying his long term disability claim.
During his employment at Burger King, plaintiff Farhad F. was covered by Unum Life Insurance Company of America, his employer’s disability benefit provider, according the Unum claim denial lawsuit.
Farhad, 50, became disabled in 2006 while he was employed at Burger King. His physical limitations made him unable to complete his normal duties that were required as part of his occupation, the Unum lawsuit said.
Initially, Farhad applied for short term disability benefits that were approved and paid. After his short term disability benefits were exhausted, he was approved for long term disability benefits.
In February, Unum contacted Farhad and informed him that he would not longer be receiving benefits, according to the lawsuit. As his plan required, Farhad appealed Unum’s decision. He said he submitted a substantial amount of medical documentation to the company that supported his inability to maintain employment because his disability continued.
In July, Unum denied Farhad’s appeal. The lawsuit said Farhad exhausted all of Unum’s administrative remedies and filed the lawsuit, the next step set out under the Employee Retirement Income Security Act (ERISA).
Farhad is seeking reinstatement of his long term disability benefits until he is no longer disabled or until he reaches 65 years of age. He is also seeking attorney fees and expenses incurred as a part of his denial by Unum.
The Unum Lawsuit is Case No. 3:15-cv-00389, in the U.S. District Court for the Western District of North Carolina, Charlotte Division.
Unum continues to be hit with individual and class action lawsuits for its allegedly “routine” denial of benefits to policy holders who meet disability requirements and who have paid all premiums.
Beginning in the 1980s, there were reports of UNUM engaging in cash flow underwriting, which involves selling many life insurance policies without regard to the potential future risks of a policy holder. There were also claims that Unum allegedly invested the money from the premiums elsewhere and made profits.
As the value of life insurance policies began to decrease, allegedly Unum began to deny benefits to qualifying policy holders. These are considered bad faith insurance practices.
