Inventory, business man with tabletAn employee of a worldwide inspection company is claiming it denied him due overtime and is seeking class certification in an unpaid overtime lawsuit.

Plaintiff Kenneth Wyatt was employed by AmSpec Services where he worked as an inspector. AmSpec operates facilities all over the world and provides inspection, testing and verification services for petroleum products. Its primary clients are companies in the oil and gas industries.

According to AmSpec’s website, AmSpec “is dedicated to providing quality service exceeding our client’s expectations. The company and employees strive for the highest degree of quality performance which is achieved through clear and well-documented systems, proper training, the qualifications and experience of employees and through continuous improvements of all overall operations.”

Wyatt performed the majority of his work from AmSpec’s Texas City office, according to this unpaid overtime lawsuit.

His main work responsibilities included inspecting oil, gas or chemicals that were being transferred from one storage facility to another. Wyatt worked at storage tanks, on vessels and on barges checking for both quality and quantity.

The plaintiff in this unpaid overtime lawsuit claims that he, as well as other workers in his same position, consistently worked over 40 hours a week. This position is a non-exempt position yet he and other workers were never paid overtime.

Wyatt claims in this unpaid overtime lawsuit that the AmSpec refused to pay both him and other workers the overtime pay that they were owed. He claims that this was done repeatedly.

Unpaid Overtime Lawsuit Names FLSA Violations

The FLSA, or the Fair Labor Standards Act, regulates minimum wage, overtime pay, record keeping and standards for child labor. Congress passed this federal law to ensure that workers would be protected from danger, exploitation and abuse by their employers.

The plaintiff in this unpaid overtime lawsuit claims that AmSpec violated the FLSA in many ways.

AmSpec Services employ a pattern, practice and policy of these illegal practices, Wyatt says. Additionally, the plaintiff claims that AmSpec has failed to maintain accurate employee records regarding the number of hours worked by Wyatt and other members of the potential class.

Because both Wyatt and the other employees are non-exempt workers, they are entitled to overtime pay if they work over 40 hours in any one seven day week.

He also claims that because AmSpec has not kept accurate records of the hours that its non-exempt employees worked they have thus further violated the FLSA.

This Unpaid Overtime Lawsuit is Wyatt v. AmSpec LLC, Case No: 3:17-cv-00162 in the United States District Court for the Southern District of Texas, Galveston Division.
