Underdog Fantasy class action lawsuit overview:

  • Who: Four consumers filed a class action lawsuit against Underdog Sports LLC, which does business as Underdog Fantasy.
  • Why: The plaintiffs allege Underdog Fantasy operates illegal sports betting under the guise of a fantasy sports platform.
  • Where: The Underdog Fantasy class action was filed in New York federal court.

A new class action lawsuit alleges Underdog Fantasy runs an unlicensed sports betting platform that it falsely markets as an interactive fantasy sports game.

Plaintiffs Brian Ballentine, JeanClaude Lominy, Lauren Wolf and Isaac Roth claim Underdog, which owns and operates an online and app-based platform, has violated gambling laws and engaged in illegal deceptive activity at the expense of tens of thousands of consumers.

The plaintiffs argue Underdog’s platform is not interactive or fantasy, but rather illegal sports betting, with consumers placing bets on the performance of particular athletes against performance metrics set by Underdog.

Underdog class action: Company operates without sports betting license

The plaintiffs argue Underdog is operating sports betting without a sports betting license. Furthermore, even if it were operating interactive fantasy sports contests, it would still need a license, and does not have one.

“By operating unlicensed sports betting, Defendant has violated gambling laws, engaged in illegal deceptive activity, and unjustly enriched itself,” the Underdog class action says.

The plaintiffs claim Underdog is guilty of violating New York General Obligations Law and New York General Business Law.

They are demanding a jury trial and request declaratory and injunctive relief and an award of compensatory and consequential damages for themselves and all class members.

Earlier last year, a similar “just for fun gameplay” operated by VGW Holdings was accused of allegedly running an illegal internet casino in the State of Georgia.

    I recently did a 7 leg parlay for about 6 thousand USD . once the game was over only 6/7 were green i thought it was mistake so i contacted the Customer service this was for the lakers vs timberwolves game (NBA) the missed leg was for Rudy gobert to make his first field goal of the night which he did according to all nba and espn official sites . underdog claims they pulls their data from nba offical site so i don’t understand why i didn’t get my payout. Customer service was very combative when trying to sort the issue i have all the proof associated with my claims . I need help

    Was recently ripped off by underdog sports after making a deposit they don’t offer services in my state and they only want to give me half of my money back even though I can’t use what I was paying for please help and thank you
