Ulta class action lawsuit overview:

A new class action lawsuit accuses Ulta Salon of violating privacy laws by intercepting, recording, decoding, capturing, disclosing and using the contents of its website visitors’ electronic communications.
Plaintiff Raeanon Hartigan claims Ulta uses a tracking pixel and related tracking technologies embedded in its website to intercept and transmit consumers’ electronic communications without their consent.
Hartigan claims Ulta also aided Meta Platforms to do the same by means of a tracking pixel and related tracking technologies embedded into its website.
“The Meta Pixel and related technologies did more than capture routing and signaling data,” Hartigan says in the class action lawsuit. “As [the] plaintiff’s own off-Facebook activity confirms, they intercepted the contents of [the] plaintiff’s and class members’ communications with the website.”
The complaint alleges tracked information included full URL strings and specific products and content viewed, which were then transmitted to Meta and other third parties.
Consumers unaware of alleged Meta Pixel tracking
Hartigan claims users were unaware that the company had installed the Meta Pixel or that the contents of their communications were being routed to third parties.
The class action lawsuit argues that Ulta and Meta’s commercial benefit constitutes “a serious invasion of privacy that is highly offensive to a reasonable person, given the breadth and sensitivity of the information and the secret manner of its collection.”
The lawsuit claims Ulta is guilty of invasion of privacy under California’s constitution, intrusion upon seclusion and violation of the Electronic Communications Privacy Act and the California Invasion of Privacy Act.
Hartigan wants to represent a class of consumers who, while physically located in California, used Ulta’s website during the period beginning June 4, 2024, through the date of judgment.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory, punitive and compensatory damages for herself and all class members.
In other legal actions against Ulta, a group of Washington consumers and residents have accused the company of sending emails with misleading subject lines to entice consumers into making purchases.
