Close-up Of Brown Gavel And Medical StethoscopeThe United States will reportedly receive $550,000 to resolve a qui tam lawsuit filed against a Pennsylvania company that oversees services for patients undergoing surgical procedures, Law360 reports.

Involved in the settlement for the qui tam lawsuit is Marshfield Medical Inc., also known as Bromedicon Inc, said to have been involved in fraudulent billing between 2011 and 2015.

The company is allegedly resolving claims that it violated the False Claims Act, reported by the company’s former manager, Diane K., by billing for Medicare patients that were seen remotely by a physician. No physicians were in fact involved in surveying live data produced by the surgical procedures, according to a press release by the United States Department of Justice (DOJ).

According to Law360, the company is said to provide remote intraoperative neurophysiological monitoring. It is a service by which physicians scan a live data stream of a patient’s neural structures to verify their shape and condition during a surgical procedure, done through the transmission of electrodes.

According to the U.S. Attorney for the qui tam lawsuit, “We thank the whistleblower in this case. Information from citizens can be invaluable in detecting and combating fraud.”

The former office manager is said to have started out working for the company part-time in 1988, handing the company’s billing. However, although she stopped working for the company in April 2012, she rose to become the company’s office manager in 2011 and began working for the company on a full-time basis.

According to Law360, there have been several ways Marshfield committed fraudulent billing that had been reported by Diane. Some of the accusations include the company falsely representing that a physician was interpreting the live data streams when in fact no one was there. The primary physician who should have been in charge of interpreting the live scan was said to be sick or in poor health signing patient charts and made up interpretation reports. He had been in a hospital bed and not monitoring live data, according to the report.

Another physician for the company was also not interpreting live data streams but was rather frequently traveling to other countries. He was also not monitoring surgeries and to show that a physician was on site, the company would log into chat services to attempt to illustrate that they were communicating with an on-site physician, Law360 reports.

According to the former manager, in some instances a physician would be on-site to monitor the live scans but there would be a violation of the industrial maximum set forth as they would monitor several scans at the same time. The industrial maximum is three live simultaneous procedures. Additionally, physicians were allegedly mandated to be pulled away as they were watching simpler monitoring scans to watch more complicated procedures, such as craniotomies.

Law360 also adds that federal prosecutors added to the former manager’s claims, stating that at times Marshfield would only have one physician on-site, a foreign medical school graduate without a U.S. license to practice medicine.
