TrueSeaMoss class action lawsuit overview:

  • Who: Plaintiff Luis Licea filed a class action lawsuit against Diva Fam Inc., doing business as TrueSeaMoss.

A new class action lawsuit alleges Diva Fam made unlawful automatic renewal and/or continuous service offers to consumers in California in violation of California’s Automatic Renewal Law (ARL).

Plaintiff Luis Licea filed the class action complaint against Diva Fam on Sept. 2 in California federal court. He alleges violations of California’s Consumers Legal Remedies Act, False Advertising Law and Unfair Competition Law.

The ARL requires businesses to provide clear and conspicuous disclosures of automatic renewal or continuous service terms, obtain consumers’ affirmative consent and provide an acknowledgment that includes the offer terms and cancellation policy, the TrueSeaMoss class action lawsuit states.

TrueSeaMoss allegedly fails to provide acknowledgment of automatic renewal terms

Licea claims he purchased a product from TrueSeaMoss and was charged a recurring monthly fee without proper disclosure of the automatic renewal terms. 

The complaint includes screenshots of the TrueSeaMoss website and checkout page, which Licea claims fail to meet the ARL’s requirements for clear and conspicuous disclosure of automatic renewal or continuous service terms.

Furthermore, the class action lawsuit alleges the company did not provide a cancellation policy nor information regarding how to cancel in a manner that is capable of being retained by the consumer.

Licea seeks to represent a class of consumers who purchased any product or service from TrueSeaMoss’s website in response to an offer constituting an automatic renewal as defined by the ARL within the statute of limitations period.

He is seeking an injunction prohibiting Diva Fam from continuing its alleged unlawful practices as well as damages, restitution and attorneys’ fees.

Meanwhile, The Clean Supps LLC, doing business as Inno Supps, recently faced a class action lawsuit alleging it misled customers by promoting fake discounts and enrolling them in automatic renewal subscriptions without proper disclosure.
