
True Blue Car Wash class action lawsuit overview:

A new class action lawsuit claims True Blue Car Wash signs up customers to memberships that automatically renew without explicit consent.
Plaintiff Monte Connors and three others claim True Blue Car Wash fails to disclose the terms of the automatically renewing memberships and makes it difficult for customers to cancel them.
“Customers who visit the Defendant’s physical car wash locations are regularly signed up for automatically renewing car wash memberships without their knowledge or consent,” the True Blue Car Wash class action states.
The plaintiffs argue True Blue Car Wash’s failure to disclose the terms of membership renewal violates the Illinois Automatic Contract Renewal Act, the Illinois Fraud and Deceptive Business Practices Act, the Indiana Deceptive Consumer Sales Act and the Texas Deceptive Trade Practices Act.
True Blue Car Wash applies ‘dark patterns’ to membership cancellations, lawsuit claims
The plaintiffs claim True Blue Car Wash uses “dark patterns” to make it difficult for customers to cancel their memberships and fraudulently charges them for canceled memberships.
“Defendant is engaged in a pattern and practice of exploiting its members by continuing to charge them monthly fees, without the members’ consent, after they have canceled their memberships,” the True Blue Car Wash class action lawsuit states.
Furthermore, the class action alleges that True Blue Car Wash fails to clearly disclose how to cancel its membership at the time of checkout. “Put simply, Defendant’s websites are void of these required disclosures.”
The plaintiffs want to represent a class of consumers in Illinois who were automatically enrolled in a Rainstorm Car Wash membership and were charged at least one renewal fee by True Blue Car Wash.
They also want to represent a class of consumers in Indiana and Texas who were enrolled in a Rainstorm or Clean Freak Car Wash membership where the price of the monthly membership was increased and/or they were charged a membership fee after they canceled the membership.
The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of actual, statutory and punitive damages for themselves and all class members.
Recently in the news, Road Runner Sports agreed to a settlement to resolve class action claims it violated California law with misleading automatic renewal disclosures.
