TRICARE Data Breach Class Action Lawsuit

TRICAREThe Department of Defense and TRICARE have been hit with a class action lawsuit seeking $4.9 billion in damages for 4.9 million beneficiaries of TRICARE whose confidential information was exposed during a recent data breach. TRICARE provides health benefits for military personnel, retirees and their families.
 
According to the TRICARE class action lawsuit, the “intentional, willful and reckless disregard of Plaintiffs’ privacy rights caused one of the largest unauthorized disclosures of Social Security numbers, medical records and other private information in recent history.”
 
The TRICARE data breach occurred when a computer tape containing personal and sensitive health information was stolen from the car of an employee of Science Applications International Corp. (SAIC), a contractor with the TRICARE Health Management Activity.

 

The TRICARE class action lawsuit alleges TRICARE “flagrantly disregarded” the privacy rights of TRICARE beneficiaries by failing to take the necessary precautions to protect their identity. It also says that data on the stolen computer tape was “unprotected, easily copied” and that TRICARE “inexplicably failed to encrypt the information.”
 
The TRICARE class action lawsuit goes on to say that TRICARE “compounded its dereliction of duty by authorizing and untrained or improperly trained individual to take the highly confidential information off of government premises and to leave unencrypted information in an unguarded car in a public location.”
 
The TRICARE data theft class action lawsuit is seeking $1,000 in damages for all 4.9 million TRICARE beneficiaries whose records were on the computer tape stolen September 13 from the SAIC employee’s car. It is also asking that TRICARE provide free credit monitoring services and reimburse those who had already purchased such services on their own.

    The guy who stold my id’ in 2011 continues to use it from state to state. Nothing is being done to stop him. How do I join this law suit. The DoD is in bed with SAIC did you see they just awarded them another huge contract. This needs to be pushed forward.

    Considering SAIC’s track record (http://archive.pogowasright.org/search.php?type=all&query=SAIC&mode=search&Submit=Search), TRICARE or the DoD sould be asked what they’ve done to ensure data was appropriately handled. What is TRICARE’s procedures for handling, backing-up and storing HIPAA and Privacy act information? If you hire a company with a track record of incompetence and you handle HIPAA and Privacy Act Data, doesn’t the responsibility rest squarely on your shoulders?
