Following a tractor trailer accident, a driver and his wife are suing the trucker and trucking company involved with the incident.
Plaintiffs Allen G. and Joey G. have filed a lawsuit against a truck driver and trucking company Robert Heath Trucking Inc. alleging that the truck driver’s negligence resulted in a tractor trailer accident.
In April 2018, Allen was a guest passenger in a 2006 Chevrolet Silverado driving on a Louisiana interstate.
While in the vehicle, which was pulling a tractor trailer, a large 18-wheeler truck allegedly hit the vehicle from behind “suddenly and without warning.”
The accident allegedly caused injury to Allen and damaged his trailer and construction equipment, including a Bobcat tractor. As a result of the tractor trailer accident, Allen claims that he suffers from headaches, back pain, shoulder pain, neck pain, a concussion, and brain injury.

Filing a Tractor Trailer Accident Lawsuit
At the time of the accident, the truck driver was operating a 2013 Volvo VN VNL, which is a large 18-wheeler truck. These vehicles are often used to transport goods over long distances and their drivers are often employed through trucking companies. Truck drivers are required to have a specific license and training to operate the large vehicles safely.
The tractor trailer accident lawsuit claims that the truck driver hit the vehicle due to negligence. Allen says the driver failed to operate his vehicle in an attentive manner, failed to maintain lookout, failed to maintain control of his vehicle, and failed to exercise appropriate care by driving his vehicle too fast.
All of these behaviors allegedly caused him to strike the vehicle and lead to the tractor trailer accident. The lawsuit claims that the driver did not implement proper care and vigilance required to safely operate any motor vehicle.
The plaintiffs also aim to hold the driver’s trucking company, Robert Health Trucking Inc., accountable. The 18-wheeler involved in the tractor trailer accident was allegedly owned by the company, and the lawsuit seeks to hold the company accountable for their employee’s negligence.
Allen claims that Robert Heath Trucking did not properly supervise and train their employees, which would allegedly have prevented the accident. The lawsuit also claims the company failed to institute proper safety and driving policies, and failed to ensure that such policies were enforced.
The tractor trailer accident lawsuit further states that Great West Casualty Co. is also accountable for the accident, as they are the insurance company responsible for Robert Health Trucking Inc. and its trucks.
The plaintiff driver claims damages of physical pain and suffering, mental anguish, emotional distress, loss of enjoyment of life, loss of income and earning capacity, medical expenses, disability, scarring, and property damages.
As Allen’s wife, Joey claims damages of loss of consortium, including “loss of society, services, support, anguish and destruction to all of the usual enjoyments of her marital relationship.”
The tractor trailer accident lawsuit seeks damages greater than $75,000 and court costs.
The Tractor Trailer Accident Lawsuit is Case No. 3:18-cv-00540-BAJ-EWD, in the U.S. District Court for the Middle District of Louisiana.
