A new class action lawsuit alleges Viator Inc. fails to itemize the base price, fees and taxes of tickets it sells online.
Plaintiff Corinna Ramlogan filed the class action on March 3, arguing that Viator.com, a Tripadvisor company, violates New York Arts and Cultural Affairs Law by not disclosing online ticket handling fees.
Ramlogan claims the law requires ticket sellers to disclose “in a clear and conspicuous manner the portion of the ticket price that represents a service charge or any other fee or surcharge to the purchaser.”
The Viator class action lawsuit says that Viator fails to itemize surcharges at any point during the process and “even after the transaction is completed.”
Ramlogan wants to represent a nationwide class of consumers who purchased tickets to any venue in New York from Viator on or after Aug. 29, 2022, when the all-in-one ticket pricing law came into effect.
Viator liable for statutory damages for each ticket sold, class action claims
Ramlogan argues Viator is liable for a minimum of $50 in statutory damages for each ticket sold during the proposed class period.
“Defendant sold at least 100,000 tickets to venues and other attractions taking place in the State of New York during the applicable class period,” the Viator class action lawsuit says.
Ramlogan claims Viator is guilty of violating New York Arts and Cultural Affairs Law, demands a jury trial and requests statutory damages for each ticket sold for herself and all class members.
In related news, Regal Cinemas recently agreed to a class action settlement, as did the IFC Center, to resolve claims that they failed to disclose booking fees when selling electronic tickets on their websites.
