The Black Tux LLC unlawfully charges customers junk fees for formal attire rentals, a new class action lawsuit alleges.

Plaintiff Alex Campos filed the class action complaint against The Black Tux LLC on Aug. 1 in a California federal court, alleging violations of state consumer laws.

According to the lawsuit, The Black Tux, a company specializing in formal attire rentals, has been secretly charging customers a hidden “Damage Waiver” fee, which is not disclosed upfront when consumers view and select rental items on its website.

The class action lawsuit claims the company’s practice of adding this fee at the last step of the rental process is a form of “drip pricing,” which has been illegal in California for years and is the subject of a proposed national ban on junk fees.

The lawsuit alleges that The Black Tux’s website displays the rental price of each item without including the Damage Waiver fee. 

Consumers are only made aware of the additional charge after they have selected their items and are ready to check out, the class action lawsuit says.

Campos argues that this practice misleads consumers into believing they are getting a better deal than they actually are, forcing them to either abandon their rental plans or pay more than they initially intended.

Campos claims he rented several pieces of formal attire from The Black Tux’s website in Aug. 2024 and was surprised to find a $12 Damage Waiver fee added to his total cost at checkout.

The class action lawsuit alleges that The Black Tux’s failure to disclose this fee upfront violates California’s consumer protection laws, including the Consumers Legal Remedies Act, the Unfair Competition Law and the False Advertising Law.

Campos is looking to represent anyone in the United States who rented any item from The Black Tux website and paid the mandatory Damage Waiver Fee that was not advertised with the initial price of the item.

He is suing for violations of California consumer laws and seeks certification of the class action, damages, fees, costs and a jury trial.

A recent class action filed against HomeDepot in Georgia accuses the company of forcing customers to pay for “optional” damage protection fees for its tool rental services.
