A Texas woman has filed a birth control lawsuit against Bayer, manufacturer of the Mirena IUD. Her lawsuit joins existing litigation that alleges the IUD is defective and dangerous.
Kathryn Stark received a Mirena IUD in February 2010. However, it was not until April 2013 that she was diagnosed with a perforated uterus, a complication in which the IUD punctures the uterus and moves into the abdominal cavity. In May 2013, Stark underwent an emergency laparoscopic surgery, according to the lawsuit.
The Mirena IUD is a birth control device designed to be inserted into a woman’s uterus. The device was designed to remain in place for up to five years, blocking pregnancy through several mechanisms. However, it has been alleged that the device could cause serious side effects.
Lawsuits against Bayer have alleged that the Mirena IUD could cause a variety of serious complications, including perforation. Allegedly, the device can punch through the uterus. Once outside of the uterus, the device can migrate around the abdominal cavity, and cause additional damage to internal organs. It typically requires surgery to remove an IUD if it punches through the uterus.
The litigation against Bayer has taken the form of a multidistrict litigation or MDL. MDLs are a type of group lawsuit, similar to a class action lawsuit. With an MDL a number of different lawsuits in different courts are linked together, which can potentially save resources for all parties involved. For example, plaintiffs can pool their resources and defendants only have to face a single, linked group of lawsuits. The MDL against Bayer over the Mirena IUD is taking place in New York.
The case is formally titled Kathryn Stark v. Bayer Healthcare Pharmaceuticals Incorporated, Case No. 7:13-cv-01244-CS, filed in the United States District Court for the Northern District of Texas, filed within the MDL In Re: Mirena IUD Products Liability Litigation, MDL No. 24334, filed in the United States District Court for the Southern District of New York.
