
A Wisconsin couple recently filed an AndroGel testosterone lawsuit against AbbVie, Inc. alleging AndroGel caused one plaintiff to be diagnosed with deep vein thrombosis.
AndroGel is a drug manufactured, sold, distributed, and promoted by AbbVie, Inc. as a testosterone replacement therapy.
Plaintiffs Henry and Kristina E. filed the AndroGel testosterone lawsuit as a result of Henry’s diagnosis with deep vein thrombosis, and the later knowledge of alleged medical risks of AndroGel testosterone medication, including DVT.
The couple claims that they, as well as other consumers, have been misled as to the safety and efficacy of AndroGel testosterone medication, and as a result have suffered medical complications and serious injuries.
According to the testosterone lawsuit, Henry began taking AndroGel testosterone medication as prescribed by his physician in May of 2012 in order to treat hypogonadism.
The AndroGel lawsuit alleges that Henry would not have used AndroGel, and his physician would not have prescribed AndroGel, had they known of the potential risk of medical complications including heart attack, stroke, pulmonary embolism, and/or deep vein thrombosis and death.
In late August 2012, Henry allegedly suffered a deep vein thrombosis (DVT). According to the AndroGel testosterone lawsuit, this DVT caused the plaintiff couple pain and suffering, financial loss, and permanent injury to Henry.
The couple alleges that AndroGel directly caused this physical and emotional impairment, which has affected Henry’s personal and professional life.
The drug is used to treat low testosterone levels, also known as hypogonadism. The AndroGel testosterone lawsuit alleges that although the defendants claim that their drug is safe and effective treatment for hypogonadism, this is far from true. The plaintiffs claim that AndroGel can cause – and has caused – serious medical problems, including deep vein thrombosis.
Deep vein thrombosis occurs when a blood clot forms in the deep veins in one’s body, and is usually located in the legs. DVT can subsequently cause leg pain or even swelling, but can exist without any detectable symptoms. The blood clots can be dangerous, because clots can break loose and eventually lodge in your lungs, then block blood flow, causing a pulmonary embolism.
According to this AndroGel testosterone lawsuit, the defendants had a duty to warn the plaintiff and the medical community of the risk of serious medical conditions such as heart attack, stroke, deep vein thrombosis, pulmonary embolism, and/or death that are associated with AndroGel.
The plaintiffs allege that AbbVie Inc. failed to provide adequate warnings concerning the risk of these medical conditions, and even failed to update warnings based on information from product surveillance and studies after the FDA’s approval.
The couple filed their AndroGel testosterone lawsuit alleging several claims, including: manufacturing and design defect, failure to warn, negligence, breach of express and implied warranties, and fraud, among other things.
