A popular treatment for low testosterone that has been in numerous commercials is the subject of a Florida man’s testosterone gel lawsuit alleging that drug maker AbbVie Inc. failed to properly warn him of the risks associated with the use of this therapy.
According to the low-t drug lawsuit, in the summer of 2010, David Bamberg was taking AndroGel, which allegedly resulted in him suffering a heart attack. Studies cited in the testosterone gel lawsuit reportedly show that the risk of heart attack and stroke, among other medical conditions, can be up to 30 percent more likely in men who are under the age of 65, and much higher in seniors.
Further, AbbVie and its subsidiary are accused of downplaying these risks at the same time that they heavily promoted the testosterone product. The phrase “Low-T” was created as an easier way of describing hypogonadism. In addition, companies that sell products like AndroGel noted that symptoms could include decrease in sexual interest and lethargy, among others. There was also a quiz that would help men decide whether to talk to their doctors, according to the testosterone gel lawsuit.
However, in addition to those symptoms also being associated with those of aging, the low-t drug lawsuit argues that the quiz was not scientifically rigorous. The New York Times published an article in which the doctor who made the quiz said that he had dashed it off and did not put too much stock in it. Still, the drug maker would continue to increase the estimated number of men who suffer from hypogonadism so that it now approaches tens of million of adults.
That is not to say that some men do not have hormone imbalances. Instead, plaintiffs like Bamberg allege that many patients are given the therapy with the attendant risks of heart attack or stroke even without testing. Low-t they argue, has become a condition that is not necessarily linked to the reality of the medical studies they cite in their complaints.
The Testosterone Gel Lawsuit is David J. Bamberg v. AbbVie Inc., et al., Case No. 14-cv-1748, in the U.S. District Court for the Northern District of Illinois.
