A number of TCPA lawsuit settlements have been reached over the past year by a variety of businesses who may have violated the Telephone Consumer Protection Act.
In these cases and most cases like them, the businesses typically do not admit any wrongdoing, yet agree to compensate consumers in a TCPA settlement designed to avoid the uncertainty, time and potential outcomes of continued litigation.
What is the TCPA?
The Telephone Consumer Protection Act is legislation that has been designed to prohibit telemarketers and others placing solicitation calls, text messages or faxes without the consent of the consumer. As part of the legislation, the National Do Not Call Registry was established where consumers can place their phone numbers on the list if they do not wish to be called by telemarketers.
Provisions of the TCPA also prohibit businesses from using automatic dialing systems. These systems have a database of phone numbers that are stored and random numbers are dialed. If you receive a phone call and there is a pause before someone picks up on the other line, it is likely that a business is using an automatic dialing system.
If businesses violate the provisions of the TCPA, consumers can take action to receive compensation up to $500 and $1500 per occurrence. As one can imagine, in class action lawsuits, TCPA lawsuit settlements can reach into the millions of dollars for companies accused of violating the law.
Recent TCPA Lawsuit Settlements
There are several class action TCPA lawsuit settlements that have recently been reached that consumers may be able to take advantage of if they were affected by unwanted phone calls or text messages. Real Time Resolutions and Wells Fargo Dealer Services currently have open settlements that consumers may qualify to receive.
Real Time Resolutions was accused of violating the Telephone Consumer Protection Act when it placed calls to consumers cellular phones using an automatic telephone dialing system and/or artificial or prerecorded voice to do so. These calls were placed without consumer consent, the lawsuit alleged. TCPA lawsuit settlements reached by Real Time Resolutions included us total of $1.3 million to resolve claims, with consumers receiving an estimated $25 each.
Wells Fargo Dealer Services denied allegations that it placed cell phone calls by using an automatic phone dialing system and/or an artificial or prerecorded voice system to call consumers, yet agreed to paying more than $14.8 million as part of its TCPA lawsuit settlements with consumers. Consumers are estimated to receive between $20 and $50 as a result of the settlement.
Other recent TCPA lawsuit settlements have had the deadline recently pass for class members to file a claim, such as with Navient Solutions and SuperAmerica.
Navient Solutions, previously known as Sallie Mae, recently agreed to two class action TCPA lawsuit settlements. As with other settlements, the plaintiffs in these lawsuits stated that they were called on their cellular phones by the company that reportedly used an automatic telephone dialing system and did so without their prior consent. Navient’s TCPA lawsuit settlements totaled more than $20 million to resolve claims, with consumers receiving an estimated $200-$350 for participating in the class action lawsuit settlement.
SuperAmerica was accused of sending unsolicited text messages to consumers using an automatic telephone dialing system. In this particular settlement, consumers who qualify could each be awarded $50 in cash and $50 in a gift card to SuperAmerica. The TCPA lawsuit settlement actual amount would be determined after all of the claims were processed, which could result in a higher payout if less class members successfully filed a claim.
