Subaru mirror defect class action overview:

Subaru has been hit with a new class action lawsuit alleging the automaker knowingly sold vehicles with defective side mirrors. 

Plaintiff Katelyn Robinson filed the class action complaint against Subaru of America Inc. on Sept. 20 in a New Jersey federal court, alleging violations of state and federal consumer law. 

The lawsuit targets 2024 Subaru Crosstrek and 2024 Subaru Ascent vehicles. According to the complaint, the vehicles’ driver’s side mirrors have a defect that causes them to vibrate and shake while driving, distorting the view of the road and other vehicles. 

This mirror defect, which Robinson alleges is caused by subpar materials or flawed design in the mirror housing, presents “an extreme safety hazard,” she claims.

Robinson’s complaint details how the shaking mirrors make it difficult for drivers to accurately judge distances and spot potential hazards, particularly at night. 

The issue is said to increase the risk of accidents when drivers attempt to merge or change lanes. Plus, the defect exacerbates glare from headlights, making night driving even more dangerous, she says.

Subaru hasn’t provided a solid fix to the problem, class action says

Despite knowing about the defect before selling the affected vehicles, Subaru has allegedly failed to issue a recall or provide an adequate solution to fix the issue. 

The lawsuit claims that Subaru continues to replace defective mirrors with parts that are equally faulty, leaving drivers to deal with the safety risk.

According to the complaint, customers have reported the mirror defect to the National Highway Traffic Safety Administration (NHTSA), but the problem persists even after attempts to fix it from Subaru dealerships.

Robinson also alleges the mirrors violate federal safety standards, which mandate that mirrors provide a clear and undistorted view of the road. 

Robinson is seeking certification of the class action lawsuit and is asking for damages, restitution, and other relief on behalf of all Texas residents who bought or leased the affected vehicles.

 The lawsuit alleges violations of the Texas Deceptive Trade Practices Act, fraudulent concealment, unjust enrichment, and breach of warranty. The plaintiff argues that, had Subaru disclosed the mirror defect, consumers would not have purchased the vehicles or would have paid significantly less.

Robinson is seeking a jury trial and is calling for Subaru to notify all affected vehicle owners about the safety issue.

Earlier this year, Subaru recalled nearly 120,000 model year 2020-2022 Outback and Legacy vehicles over concerns they may have been equipped with defective front passenger air bag sensors.
