stryker-orthopaedicsAnother metal hip implant lawsuit was filed against Howemedica Osteonics and its Stryker Orthopaedics division as part of the national Stryker hip implant multidistrict litigation (MDL).

The Stryker Rejuvenate and ABG II modular hip implants are uniquely designed medical devices. Unlike traditional hip implants, the modular neck stems are adjustable pieces that allow for variations in a patient’s femoral component length, allowing for a custom fit.

Metal hip implants like the Stryker Rejuvenate and ABG II are expected to last 15 to 20 years. However, according to recent reports and lawsuits like the one filed by Darla, the Stryker Rejuvenate and ABG II modular hip implants allegedly begin to corrode and fail only two years after implantation. Because of metal hip implant complication associated with the Stryker products, The Stryker Rejuvenate and the ABGII were recalled in July 2012.

As a result of the possible metal hip implant side effects and complications resulting from a failed hip implant and resulting hip implant explantation surgery, many consumers have filed Stryker metal hip implant lawsuits or have joined Stryker metal on metal hip implant class action lawsuits.

Stryker Metal Hip Implant Lawsuit

According to the Stryker metal hip implant lawsuit, plaintiff Darla S. of Alaska suffered injuries from her use of the Stryker Rejuvenate/ ABG II metal hip replacement product. She claims that she was implanted with the Stryker metal hip implant device in her right hip in February 2011 at her local hospital in Anchorage.

In her Stryker metal hip implant lawsuit, the plaintiff claims  she suffered personal injury and economic loss because she was implanted with the allegedly defective Stryker Rejuvenate hip implant. At the time that she sustained these metal hip implant side effects, Darla says she could not have known that her injuries were a result of the allegedly defective Howemedica device until after the metal hip implant was recalled.

Also, the Stryker metal hip implant lawsuit alleges that Darla could not have known that she was injured by excessive levels of chromium and cobalt until after she had blood drawn and was advised by a physician that based on the blood work abnormalities could be attributed to the Stryker metal hip implant.

Darla accuses Stryker of negligence, strict products liability-design defect, manufacturing defect, failure to warn, breach of express warranty, breach of warranty as to merchantability, breach of implied warranties, violation of consumer fraud, negligent misrepresentation, and unjust enrichment.

The Stryker Metal Hip Implant Lawsuit is Case No. 0:15-cv-02997-DWF-FLN and is part of the Stryker Hip Implant MDL, In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, MDL No. 2441, in the U.S. District Court for the District of Minnesota.
