Stryker Corporation is facing a new Stryker Accolade lawsuit from a New York couple alleging serious metal hip implant complications.
The Stryker Accolade lawsuit alleges the husband had experienced serious metal hip implant complications, soon after having the device implanted. The Stryker Accolade lawsuit was filed by plaintiff couple Bernard H. and Anita H. after allegedly experiencing problems often associated with device failure.
According to the Stryker Accolade lawsuit, Bernard underwent total right hip replacement surgery on Sept. 23, 2008 and had opted for the Stryker metal hip implant after reviewing the company’s marketing claims.
After his right hip surgery, Bernard underwent total left hip replacement surgery on Sept. 1, 2009 to restore total function to his pelvic bones. Similar to when he received the right hip implant, Bernard had opted for the Stryker metal on metal hip implant after reviewing the company’s marketing materials.
According to the Stryker Accolade lawsuit, Bernard had sustained significant nerve damage and even damage to his nervous system. Bernard had to be hospitalized to treat these injuries, and is still contending with his new conditions.
Bernard and his wife say they chose the Stryker metal hip implant based on the reassurances and benefits promised in the Stryker advertisements. In these marketing materials, they allege Stryker failed to adequately mention potential metal hip implant complications.
In addition, Bernard says he followed all physician instructions and did not use the metal hip implant outside of its intended purpose. Even with this diligence, Bernard still allegedly sustained metal hip implant complications and is filing this Stryker Accolade lawsuit against the company for failure to warn, negligence, fand other claims.
Overview of Stryker Metal Hip Implant Complications
Like other metal hip implants, the Stryker Accolade hip implant was developed to replace damaged or deteriorated pelvic bones.
When metal on metal hip implants were first released into the market, they were thought to be overtly superior to ceramic or plastic models. Not only were they marketed to be longer lasting, but most of them could be customized for each patient’s body. Metal hip implants are especially popular for young patients who live a more active lifestyle.
However, it did not take long for manufacturing companies to face negligence allegations from patients claiming their metal hip implants were either defective or unreasonably dangerous.
When the ball and socket joints of metal hip implants interact, they may shed metal ions into the bloodstream and can quickly worsen the patient’s medical situation. These metal hip implant complications can range from discomfort to blood metal poisoning, or metallosis, which can ultimately cause extreme pain and device failure.
According to this Stryker Accolade lawsuit, Bernard’s metal hip implant complications have permanently compromised his life and marriage. Bernard states that he never would have opted for the Stryker metal hip implant if he had known the potential risks associated with the product.
This Stryker Accolade Lawsuit is Case No. 1:17-cv-00517, in the U.S. District Court for the Western District of New York.
