Spectrum Cable class action lawsuit overview:

  • Who: Plaintiff Richard Wookey filed a class action lawsuit against Charter Communications (DE) Inc., doing business as Spectrum Cable, and Charter Communications Operating LLC, doing business as Spectrum.
  • Why: Wookey claims Spectrum Cable overcharges customers with deceptive fees.
  • Where: The Spectrum class action lawsuit was filed in Kentucky federal court.

A new class action lawsuit alleges Charter Communications overcharges Spectrum Cable customers with a deceptive “Broadcast TV Surcharge” fee. 

Plaintiff Richard Wookey claims Charter, which does business as Spectrum Cable, uses the Broadcast TV Surcharge fee to “secretly” increase the monthly rate of its cable TV service plans.

Wookey argues that the Broadcast TV Surcharge fee is “deceptively named” to make it appear as if it is a government-related fee or tax when it is actually a “disguised” price increase.

“Charter has made this fee appear to be a legitimate government-related fee when, in fact, it is simply a way for Charter to advertise and promise lower rates than it actually charges,” the Spectrum class action lawsuit states.

Wookey wants to represent a nationwide class of consumers who paid Charter’s Broadcast TV Surcharge fee during the maximum limitation period.

The plaintiff accuses Charter of breach of contract, unjust enrichment and violating Kentucky’s Consumer Protection Act, among other things, and demands a jury trial.

Charter ‘deceptively’ advertises Spectrum service at lower monthly rates, class action claims

Wookey claims Charter “deceptively” advertises its Spectrum cable TV service plans as having a lower monthly rate than what it actually charges.

“Charter’s advertisements and contracts do not clearly and conspicuously disclose the true price of its services, instead concealing the Broadcast TV Surcharge fee in the fine print,” the Spectrum class action lawsuit says.

Wookey argues Charter’s alleged practice of charging a deceptive fee has caused him and other consumers to pay “substantially more” for Spectrum cable TV service than what they were led to believe it would cost.

“Charter’s deceptive fee practices have caused substantial harm to consumers like Plaintiff, who have been misled about the true cost of their cable TV service,” the Spectrum class action lawsuit claims.

In other entertainment news, Disney has agreed to a class action settlement that accused the company of driving up streaming costs by forcing its expensive ESPN sports channel onto streaming platforms.

    Spectrum cable charges are very high and every time I pay s bill it goes up and they won’t let other companies come in here to help us save some money

    Geez, where do I start? I was with Charter Communications before they became Spectrum. I was flagged down by one of their employees when I was was in Target. They wanted to sign me up with Spectrum. I said, “I’m with Charter Communications. How can I get the deal you are talking about?” He didn’t want to talk to me after that. Later, my bill automatically became Spectrum and my rates went up. I went in to talk to them and I found out that I was being charged for having ‘old equipment’. I.E. Their Modem, which I was renting from them. They never once told me about this. They were just taking the money. I found out what equipment would be compatible and I purchased one on-line. Then I re-negotiated my bill. It went down to about $49 per month. Within six months, it was up to $89 a month. I had the lowest tier of service and it was only internet. I didn’t have phone or cable TV through them. Eventually, I went in to re-negotiate with them again. The bill went down to $49 again. I talked to a friend of mine who lives on the same block and she was paying like $39 and it never changed. Within another six months, my bill was back up to $89. I went in, again, to re-negotiate the bill. Some punk with a bad haircut tried to give me the hard sell about paying the bill with my credit card. It would be a cold day in Hell before I let Spectrum have my credit card info. I just stared at him and said, “Nope. That’s not happening. I’m here to renegotiate the bill. Again.” When it started climbing back up again, I started looking for a new provider. The problem is that the city you live in, negotiates with these companies too. It’s like they have their own little Fiefdoms. The Technicians with Spectrum are cool. They helped me out a couple of times. The rest of them are lying, money grubbing scum.

    In Wisconsin my spectrum bill showed almost a $50 government surcharge in 2024 & 2025

    We’ve had spectrum for years all the fee are absolutely absurd.
