Top Class Action viewers are starting to receive checks from the SolarCity settlement worth as much as $94.91.

Plaintiff Jose Albino Lucero Jr. claims that he and many other consumers received numerous marketing calls made by or on behalf of SolarCity.

Allegedly, the calls were made to advertise SolarCity’s solar panels to potential customers.

The SolarCity class action lawsuit claimed that some call recipients did not give their consent to receive the calls, so the calls violated the Telephone Consumer Protection Act (TCPA).

Additionally, Lucero alleged that the calls also violated the TCPA because many of them were made from automatic dialing machines or were robocalls.

“Many of these calls were made using a computer voice imitating a live call center representative. All of these calls were made using an autodialer,” the class action lawsuit alleged.

Lucero claims that his phone number, along with the phone numbers of many other consumers who were called, was listed on the National Do Not Call Registry for many years.

He claims that SolarCity’s practice of calling numbers on that list also violates the Telephone Consumer Protection Act.

SolarCity maintains that the allegations in the TCPA violation class action lawsuit are false, but agreed to settle with consumers nonetheless, in the interest of avoiding the expenses of ongoing litigation.

This settlement deal also resolves a similar class action lawsuit against the company that was filed in Massachusetts federal court.

The Telephone Consumer Protection Act is a federal law enacted in 1991 to protect consumers from being bothered by advertising and marketing via their telephones, in the form of “telemarketing.” The TCPA prohibits businesses from:

  • Sending calls, text messages, or faxes to consumers without their prior consent
  • Not providing a way to opt in or out of the communications
  • Calling numbers listed on the National Do Not Call Registry or on other “do not call lists”

Consumers can take action against businesses who violate the law by filing TCPA lawsuits or joining a TCPA class action lawsuit. Consumers who submit a valid claim of a TCPA violation can collect between $500 and $1,500 per violation. 

The deadline to file a claim for the SolarCity telemarketing class action settlement was April 16, 2018.
