A $15 million settlement has been reached in a class action lawsuit alleging marketing calls made on behalf of SolarCity Corp. violated the Telephone Consumer Protection Act (TCPA).
If you, between Nov. 6, 2011 and Oct. 16, 2017, received one or more calls on your cell phone on behalf of SolarCity, you may be entitled to a cash payment from the SolarCity TCPA class action settlement.
According to plaintiff Jose Albino Lucero Jr., marketing calls made by or on behalf of SolarCity violated the TCPA because some call recipients did not provide their consent to receive the calls. According to the TCPA class action lawsuit, the marketing calls offered SolarCity solar panels.
Lucero alleges that numerous robocalls were made by or on behalf of SolarCity to consumers’ residential and cellular telephones. “Many of these calls were made using a computer voice imitating a live call center representative,” the SolarCity class action lawsuit alleges. “All of these calls were made using an autodialer.”
According to the TCPA class action lawsuit, Lucero did not give SolarCity prior express written consent to receive the marketing calls. Further, he claims his phone number was listed on the National Do Not Call Registry for years. He says the SolarCity marketing calls violated the TCPA.
The Telephone Consumer Protection Act prohibits companies from using an autodialer and an artificial or prerecorded voice to contact consumers on their telephones without their prior express written consent. The TCPA also prohibits companies from calling numbers listed on the National Do Not Call Registry or on company-specific do-not-call lists.
Under the TCPA, consumers may be able to collect $500 to $1,500 in statutory damages per violation.
SolarCity maintains that the allegations in the TCPA class action lawsuit are without merit, but it has agreed to a class action settlement to avoid the burden and expense of ongoing litigation. If it is approved, the TCPA settlement will also resolve a similar SolarCity class action lawsuit that was filed in Massachusetts federal court.
The deadline to exclude yourself from or object to the SolarCity TCPA class action settlement is Dec. 15, 2017.
Who’s Eligible
Class Members of the SolarCity TCPA settlement include all individuals in the United States who, between Nov. 6, 2011 and Oct. 16, 2017, received from or on behalf of SolarCity one or more calls on their cell phones or at least two telemarketing calls during any 12-month period in which their phone number was listed on a National or State Do Not Call Registry or on SolarCity’s internal do-not-call list more than 15 days before the calls.
Potential Award
Class Members will receive a pro rata share of the $15 million settlement fund. The amount each Class Member is eligible to receive depends on the total number of Class Members who submit timely and valid Claim Forms.

I never received a check or letter to this effect. Waiting to hear from someone. I tried the phone number and that does not work
I would like a copy of my check to show that I filed a claim. I got the check, but I never cashed it. I just want a copy or receipt that the check was sent out.

I filed a claim and provided all the correct information. I have a confirmación code even. I cannot call through the phone number provided nor pull up the website provided. Cannot check on the estatus or anything!
