- Why: Battle claims the company’s website is inaccessible to visually impaired consumers.
- Where: The Skims class action was filed in Illinois federal court.
A new class action lawsuit alleges Skims Body Inc.’s website is not accessible to visually impaired consumers.
Plaintiff Andre Battle claims the Skims website contains “significant access barriers” that make it difficult for visually impaired consumers to use.
“In fact, the access barriers make it impossible for blind and visually impaired users to even complete a transaction on the website,” the Skims class action lawsuit says.
Battle claims the Skims website excludes visually impaired consumers from the full and equal participation in the growing internet economy, which is “increasingly a fundamental part of the common marketplace and daily living.”
“Despite readily available accessible technology, such as the technology in use at other heavily trafficked retail websites, which makes use of alternative text, accessible forms, descriptive links, resizable text and limits the usage of tables and JavaScript, Defendant has chosen to rely on an exclusively visual interface,” the Skims class action says.
Battle wants to represent a nationwide class of all legally blind individuals in the United States who have attempted to access the Skims website and as a result have been denied access to the enjoyment of its goods and services.
Skims website discriminates individuals with disabilities, class action alleges
Battle claims the Skims website is not in compliance with the Americans with Disabilities Act (ADA), which provides a “clear and national mandate” for the elimination of discrimination against individuals with disabilities.
“Such discrimination includes barriers to full integration, independent living and equal opportunity for persons with disabilities, including those barriers created by websites and other public accommodations that are inaccessible to blind and visually impaired persons,” the Skims class action argues.
Battle argues he was unable to make an online purchase on the Skims website due to its lack of features and accommodations.
“Unless Defendant remedies the numerous access barriers on its website, Plaintiff and Class Members will continue to be unable to independently navigate, browse, use and complete a purchase on Skims.com,” the Skims class action states.
Battle claims Skims is guilty of violating the Americans with Disabilities Act.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of nominal damages and costs and expenses.
A consumer filed a class action lawsuit against Skims in 2024 over claims the company violated federal telemarketing laws by sending marketing text messages at unlawfully early hours of the morning.
