SharkNinja class action lawsuit overview:

  • Who: A consumer has filed a class action lawsuit against SharkNinja Operating LLC.
  • Why: The plaintiff claims SharkNinja sold pressure cookers with a dangerous defect that can cause burn injuries.
  • Where: The SharkNinja class action lawsuit was filed in Massachusetts federal court.

A new class action lawsuit claims SharkNinja sold dangerous and defective pressure cookers that pose a serious risk of burn injuries.

Plaintiff Lauren Wolf-Bond filed the class action complaint against SharkNinja on May 9 in Massachusetts federal court, alleging violations of state and federal consumer laws.

The lawsuit alleges that SharkNinja sold pressure cookers with a defect that allows the lid to be opened during use, causing hot contents to escape and posing a risk of burn injuries to consumers.

In May, SharkNinja issued a recall for more than 1.8 million of its Foodi OP300 Series Multi-Function Pressure Cookers due to a significant burn hazard. However, the lawsuit alleges that the recall was grossly deficient and failed to remedy the critical safety defects.

The recall only offered a repair remedy, which the lawsuit claims is insufficient because it does not account for the price devaluation of the product, the fact that the product cannot be used for its intended purpose and the serious health and safety risk it poses.

SharkNinja failed to disclose defect to consumers, class action alleges

The lawsuit claims that SharkNinja knew or should have known about the defect based on pre-market testing, quality assurance protocols, consumer complaints, warranty claims and internal engineering analyses before placing the defective product into the stream of commerce.

Despite this knowledge, the lawsuit alleges, SharkNinja failed to disclose the existence of the defect to consumers at the time of purchase.

The lawsuit seeks to represent all persons in the United States who purchased the defective product for personal use and not for resale during the maximum period allowable by law. It asserts claims for breach of implied warranty of merchantability, violation of California’s Consumers Legal Remedies Act, unjust enrichment/quasi-contract, violation of California’s Unfair Competition Law and violation of California’s False Advertising Law.

The lawsuit seeks certification of the class action, an order requiring SharkNinja to recall all pressure cookers still in circulation and provide a truly effective remedy for all affected consumers.
