WARNING EPIPEN IS TRYING TO TAKE UNCASHED CHECKS AND REDISTRIBUTE THEM. THIS IS HAPPENING IN MULTIPLE CLASS ACTIONS. THE CLAIMS ADMINISTRATORS RUST, EPIQ, AB DATA ARE THE WORST. TRYING TO TAKE YOUR MONEY. THE LAW SAYS THEY ARE SUPPOSED TO TURN OVER TO UNCLAIMED PROPERTY. YOU MUST OBJECT TO THE COURT IF YOU DID NOT GET PAID AND LET THE JUDGE KNOW. THEY OFTEN DO THIS TO GET MORE ATTORNEY FEES AND EXPENSE FEES. I AM NOT AN ATTORNEY AND YOU SHOULD CONSULT ONE BUT HERE ARE SOME CASES AND LANGUAGE. Uncashed checks must be turned over to unclaimed property for your state. All Plaintiffs v. All Defendants, 645 F.3d 329 (5th Cir. 2011). The State of the last known address of the claimant is the state law that must apply to the uncashed check. Mast v. Go 2 Transp. LLC, No. CV-16-01022-PHX-ROS (D. Ariz. Jan. 25, 2019).For those without an address, it must be sent to the state where the claims administrator is incorporated. Pennsylvania v. New York, 407 US 206 (1972).
Class Counsel should be advocating for all claimants to receive their check, not trying to get that money for attorney fees or redistributed to other claimants. That is a conflict of interest. “[T]he Due Process Clause of course requires that the named plaintiff at all times adequately represent the interests of the absent class members.” Phillips Petroleum Co. v. Shutts , 472 U.S. 797, 812, 105 S.Ct. 2965, 86 L.Ed.2d 628 (1985).
