According to a recent news report by KTLA 5, a swimming pool drowning lawsuit has led the Murrieta Valley School District to pay $11 million after the death of a 13-year-old boy.
The settlement was announced by the family of the boy who died in the school drowning incident in 2016.
The swimming pool drowning lawsuit was filed on behalf of Alex P. who was declared brain dead a month after the drowning incident at Vista Murrieta High School on June 3, 2016, reported KTLA 5.
According to the news report, the surveillance video showed Alex as he slipped into the pool and remained under for almost two minutes. No rescue efforts to help the boy were done by faculty, personnel, or lifeguards present.
According to the attorney who represented the family in their swimming pool drowning lawsuit, “Instead, it was Alex’s classmates who brought him to the surface where two student lifeguards put him on a floating backboard and kept him in the pool for approximately seven minutes without performing any life-saving measures,” they stated.
Additionally, during the end-of-year party for Dorothy McElhinney Middle School, a seventh-grader was pulled from the bottom of the pool, KTLA reports. The end-of-year party hosted almost 100 of his fellow choir and band members.
It was only when paramedics arrived that the boy was retrieved from the pool and was administered CPR. He was taken to a hospital and then airlifted to another because of his injuries.
The swimming pool drowning lawsuit alleged that the school district’s policies and practices regarding pool safety were so inadequate, they were negligent and lead to Alex’s death.
A court order was obtained by Alex’s mother, Sabrina P. to keep him on life support hoping for improvement. Final goodbyes were said on July 7, 2017, at the Naval Medical Center by the family. The goodbyes were said once the family confirmed that the boy was in fact brain dead.
According to his mother’s statement, “Alex had a chance to survive this incident but was failed time and time again by so many, he deserved more than what he was given that day and our hearts are forever broken because of it.”
Changes in safety protocol are being made at Murrieta Valley Unified School District in addition to the district’s $11 million payout. The safety protocols will also be shared throughout the state at other school districts.
According to the law firm, “In a letter of apology to the Pierce family, MVUSD recognized that no amount of money will make up for the loss of Alex’s life.”
