- Why: Flores claims the San Francisco Giants charge hidden junk fees for tickets to the team’s home games.
- Where: The class action lawsuit was filed in California federal court.
A new class action lawsuit alleges the San Francisco Giants charged hidden junk fees for tickets to the Major League Baseball team’s home games.
Plaintiff Juan Flores claims the San Francisco Giants have been systemically deceiving fans by falsely advertising ticket prices for their baseball games.
Flores argues the team has been failing to disclose the full cost of tickets upfront by adding last-minute fees, such as service, convenience, handling and order processing fees, which often increase the total cost by more than $50 per transaction.
As a result, Flores claims the ticket prices advertised by the Giants are not the actual prices consumers end up paying. He also argues the fees disproportionately affect lower-income consumers, making it harder for them to pay their bills.
Flores wants to represent a nationwide class of individuals who purchased a ticket from the San Francisco Giants through the MLB Ballpark app or the desktop or mobile versions of mlb.com and paid a service, convenience, order processing and/or other similar fee that was not included in the originally displayed price.
San Francisco Giants never refunded fans, class action claims
Flores argues the Giants’ use of these last-minute, mandatory fees, referred to as “junk fees,” is a form of deceptive advertising known as “drip pricing” or “bait and switch.”
The class action lawsuit claims these practices are illegal in California under the Honest Pricing Act (HPA), which went into effect on July 1, 2024.
While the Giants stopped charging undisclosed junk fees around July 2024, Flores argues the team has not refunded fans the millions of dollars they were previously charged.
In addition to allegedly violating the HPA, Flores claims the San Francisco Giants violated California’s Consumers Legal Remedies Act, Unfair Competition Law and False Advertising Law.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory and monetary damages and punitive or exemplary damages for himself and all class members.
In another recent complaint involving an MLB team, a trio of Boston Red Sox fans filed a class action lawsuit against the team in January over claims it falsely advertised ticket prices by failing to disclose mandatory junk fees.
