samsung-logoMirroring a similar suit filed in March, Samsung Electronics has found itself facing another defective washing machine class action lawsuit.

According to the text of the complaint, plaintiff Kyle Noonan purchased a Samsung washing machine in 2012 from a Sears in New York.

He alleges that defects in the design of the Samsung washing machine caused it to leak and cause roughly $800 in damage to his home.

The plaintiff says he had a conversation with a service technician who told him that the pump housing had cracked, allowing the drum to wobble off balance and smash against the inside of the washing machine. This caused the machine to allegedly fail to spin and properly drain water.

Although Sears Home Services repaired the washing machine, “neither Sears nor Samsung offered to cover the associated damages caused by the flooding,” the plaintiff claims.

The text of the Samsung washing machine lawsuit holds that this could have been much worse. Per the complaint, “within the last few minutes of the machines’ spin cycles, the machine can reach speeds of up to 1,100 RPM.”

The Samsung washing machine lawsuit alleges that if the drum becomes compromised, it can “violently strike” the inside of the washing machine and “can explode, sending debris flying in all directions.”

The allegations hold that even in less dramatic failures, serious flooding can happen in the owner’s home.

Samsung faced a similar washing machine lawsuit last March alleging catastrophic failure. Like this current washing machine lawsuit, Suzann Moore, et al. v. Samsung Electonics took the form of a class action lawsuit.

This new Samsung washing machine lawsuit holds that Samsung has been aware of this problem.

According to the complaint, people have made these allegations dating all the way back to 2011, and sites on the internet feature dramatic pictures—some reproduced within the text of the complaint—of Samsung washers that appear to have ripped themselves apart as described in the text of the washing machine lawsuit.

Potential Class Members in this current washing machine lawsuit could include anyone who purchased a Samsung washing machine and had it explode. Such a suit could seek to recoup the cost of washer, damage to the home, and attorney fees.

The plaintiff is represented by Benjamin D. Elga and Charles J. LaDuca of Cuneo Gilbert & Laduca, LLP; Clayton D. Halunen, Melissa Wolchansky and Amy E. Boyle of Halunen Law; Edward A. Wallace, Amy E. Keller, and Tyler J. Story of Wexler Wallace LLP; Shannon J. Carson and Michael Fantini of Berger & Montague, P.C.; Gregory F. Colman and Lisa A. White of Greg Coleman Law PC; and John A. Yanchunis of Morgan & Morgan Complex Litigation Group.

The Samsung Defective Washing Machine Class Action Lawsuit is Kyle Noonan, et al. v. Samsung Electronics America Inc., et al., Case No. 1:16-cv-05271, in the U.S. District Court for the Southern District of New York.

I have confirmed thst my machine is one of concern with Samsung, and have been told they are still deciding what they want to do about it. My machine runs through a wash cycle and then when it gets to the spin cycle refills with water and we have had to hand ring clothes to be able to dry them. We are using so much water because it automatically refills. I have been washing on delicate and and only doing small loaks (a few normal sized towels) and it can’t even handle that. We bought our machine in Aug or Sept of 2013. I keep seeing many people with the same issues and nothing being done. I am nervous to use the machine in my home. I would like more info on the lawsuit if Samsung is not going to do anything about the dangerous and faulty machines.

Our washer machine has flooded twice in a month causing water damage. Called Samsung they are aware of issue but have not returned my call. Called Consumer protection and reported issue too.

I purchased a Samsung washing machine and it leaked water out of the bottom, we had no idea where the watr came from. Repair man comes and puts in a new water sensor. Then the same things started happening on the spin cycle. It would bang and not rinse the clothes out. I had to redistribute clothes about 4 or 5 times and finally it would spin, leaving me totally angry! Repair man said that he would have to take machine apart to fix it.Over 300.00 canadain .We ended up buying a new washing machine and not a Samsung

Me too! The whole load of water drained out onto my floor and through my floor into my basement! What a mess. We had to cover the damages with our insurance. I worked for months to complain to Samsung finally getting the answer that there is nothing they can do if our insurance covered it……..so I’m out my deductible as well. Now am afraid to use my “fixed” washer.

I called Samsung yesterday (9/28/16) and confirmed my washing machine was “included in this concern” but was offered NO resolution. How can I become involved in this lawsuit!??? I called 6 months ago because the tub was becoming so off balance it continued to reset (and increased my water bill) but was told time they had received NO complaints on this issue….A LIE FROM SAMSUNG! I need to become involved in this lawsuit!!!!!

  6. Jeannette says:

I had my washer explode while washing a small load of linens! I was advised by a Sears technician that it was my fault and they refused to replace until I posted on social media. The washer was replaced a month later. Now i see I need to be concerned about the same thing happening again! I have pictures to show what happened as well as the load that was in the wash when it happened! Samsung never replied or acknowledged my comments or posts!

I bought my Samsung Washer February 2010 from PC Richards it is out of warranty. The machine gets thrown off balance on the spin cycle, the drum violently shakes hitting all sides of the machine, the machine doesn’t take water, instead water leaks out of machine basement was flood. Call Samsung was told that machine is out of warranty and they can’t do anything. Had a certified repairman came and try to fix it was told that it will cost $400+ to repair it since the DRUM was crack. I decide to buy new washer since the cost was a few dollar’s more..

I bought my Samsung washer May 2013 from Best Buy it is out of warranty. The machine gets thrown off balance on the spin cycle, the drum violently shakes hitting all sides of the machine, then the machine resets itself fills back up with water & I can never get a full good spin to get the water out of the clothes I have to ring the clothes out by hand. I had a repairman come and fix the machine Samsung requests that all suspension rods to be replaced because when this particular machine was originally made the suspension rods were a piece of crap now they have gotten new ones that are supposedly better, same issues still. There needs to be a class action lawsuit, I have spent countless hours researching Samsung wash machines have so many issues with suspension rods, bleach trays rusting out, the drain pump breaking flooding customers homes, bottom of the machine busting out and some of the machines even caught fire!!! This is not right something needs to be done!!!
